Legal background

Female breast

Since July 7, 1992 , it has not been unlawful for women in New York to be bare-breasted in public, provided that they are not engaged in commercial activity in such a situation. This was preceded by a picnic by seven women in Rochester Park in 1986, during which they showed “the part of the breast that begins below the areola attachment”. The corresponding law ("Penal Law § 245.01") was determined by the United States Court of Appeals to be discriminatory because it declared parts of the female body, but not the male body, to be "private or intimate".
