Speeder

from Wikipedia, the free encyclopedia

As speeders are road users referred to wantonly in the road with clearly excessive speed driving. There is an increased risk of accidents when racing , which means that speeders often endanger other road users. Lawn or excessive speed is one of the main causes of accidents , along with distraction and inattention . The term speeder can be a derogatory term. Speeders causing fatal accidents have recently been convicted of murder.

Physical basics

The kinetic energy ( kinetic energy ) of a vehicle, which has a destructive effect in the event of an impact, as well as the braking distance are proportional to the square of the speed. The following applies:

Kinetic energy

Braking distance during emergency braking

This means that in an accident at 200 km / h, for example, four times the amount of energy must be dissipated by a sudden reduction in speed (crash) compared to an accident at 100 km / h. The mass of the vehicle, however, “only” has a linear effect on the kinetic energy. In the event of an accident, a vehicle with a mass of two tons has the potential to provide twice as much energy as one with only one ton.

The braking distance of a car at 200 km / h is also four times longer than that of the same vehicle at 100 km / h.

personality

According to the Cologne police, the “typical speeder” is between 18 and 25 years old, male and often has a migration background. Often he still lives with his parents and has only a low income. He tries to compensate for a lack of professional success with recognition for his car. "The accelerator pedal serves as a valve to release pressure." "Speeders have the illusion that they are in control of the situation and suppress the risks."

Monitoring and legal evaluation

Germany

In Germany , speeders have to expect fines and points in Flensburg . The amount of the fine depends on the amount of the speed limit and can be up to 600 euros (out of town) or up to 680 euros (in town). The number of points is also staggered: One point is awarded if you drive 21–30 km / h (urban) or 21–40 km / h (extra-urban) too fast, from 31 km / h (urban) or 41 km / h (out of town) there are two points. In addition, a driving ban for one (30–50 km / h in built-up areas or 40-60 km / h outside built-up areas too fast) up to three months (over 60 km / h in built-up areas or more than 70 km / h outside built-up areas too fast) is imposed.

To combat the number of speeders, the police have been running state-wide and state-wide lightning marathons on a regular basis since 2012 .

In the summer of 2017, the sanctions for participating in illegal car races were increased. Until then, it was an administrative offense that was only threatened with a fine of 400 euros and a one-month driving ban; since the tightening, participation in illegal car races is a criminal offense that can be punished with imprisonment of up to two years or a fine; The threat of punishment increases to ten years if someone is seriously injured or killed ( Section 315d StGB ). In addition, the motor vehicle of a razor can be confiscated ( § 315f StGB).

In February 2017, for the first time, two speeders who had fought an illegal car race on Kurfürstendamm and Tauentzienstrasse in Berlin , killing a 69-year-old man, were sentenced to life imprisonment for murder. The Federal Court of Justice overturned the judgment on March 1, 2018 because the conditional killing intent had not been sufficiently proven and referred the case back to the Berlin district court . However, on March 26, 2019, this confirmed the murder charge and the sentencing to life imprisonment. On the same day, counsel for the convict said he had already revision inserted; the judgment is therefore not yet final.

In a comparable case in Cologne-Deutz , the two perpetrators were initially only sentenced to suspended sentences in 2016. These judgments were overturned by the Federal Court of Justice and the case was referred back to the Cologne Regional Court . In March 2018, the two defendants were sentenced to prison terms without parole for negligent homicide . The appeal against it by one of the two defendants was dismissed on December 4, 2018; so both perpetrators are legally convicted.

In 2018, the Hamburg Regional Court sentenced a taxi thief who wanted to flee from the police in the stolen vehicle and caused a fatal accident for murder to life imprisonment . In March 2019, the Federal Court of Justice confirmed the judgment.

Switzerland

Since January 1, 2013, stricter speeding regulations have been in place in Switzerland .

As a speeder is now

  • if you drive through a 30 km / h zone at 70 kilometers per hour ,
  • Anyone who is traveling at 100 km / h at a permitted 50 km / h in urban areas,
  • who is out of town at a permitted 80 km / h with 140 km / h and
  • anyone who drives at least 200 km / h on highways at a permitted 120 km / h.

Rasern's ticket will initially be withdrawn for two years, and permanently if it does so . The vehicle can be confiscated in the event of gross misconduct. A new minimum sentence of one year imprisonment applies to traffic offenses related to turf, the maximum sentence is four years.

In the case of a German who had been guilty of Raser offense in Switzerland guilty and this in absentia to 30 months ' imprisonment , of which one year necessarily had been sentenced, which ruled Stuttgart Court in an exequatur , the sentence can be enforced in Germany , although turf was only an administrative offense and not a criminal offense in Germany at the time of the offense . The judgment was harsh, but not unbearable, according to the court. The speeder began his custody in October 2018.

Austria

In Austria, racers are threatened with fines, charges and driving licenses withheld. As of September 1, 2009, uniform penalties for excessive speeding were introduced. The amount of the penalty is 30 euros for violations of up to 20 km / h, 50 euros for over 20 to 30 km / h and 70 euros for over 30 to 40 km / h. If there is also a complaint, fines of up to 726 euros (if the speed limit is exceeded by up to 30 km / h) or up to 2,180 euros (if the speed is exceeded by more than 30 km / h) can result. In addition, depending on the speed limit, the driver's license will be withdrawn for a certain period of time (two weeks to six months for the first relevant offense).
