Reinhard Gaier

Reinhard Gaier (born April 3, 1954 in Lampertheim / Hessen ) is a German lawyer. From November 2004 to November 2016 he was a judge in the First Senate of the Federal Constitutional Court . Before that, he had been a judge at the Federal Court of Justice since 2000 .

Life

Reinhard Gaier passed the first state examination in Mannheim in 1980 and the second in Wiesbaden in 1982 . From 1983 to 1985 he was a probationary judge in the Darmstadt District Court . During this time he worked at the Darmstadt Regional Court and at the local courts in Fürth (Odenwald) and Michelstadt . From 1986 to 1993 Gaier was then a judge at the Darmstadt Regional Court. In 1992 he was seconded to the Higher Regional Court in Frankfurt am Main , and finally a judge there in 1993.

In 1998 he received his doctorate in Dresden . His doctoral thesis was entitled "judgment factual and orality - For context, the certification function of the sentencing facts with the provisions of the Code of Civil Procedure on the oral hearing".

In 2000 Gaier became a judge in the 5th civil senate of the Federal Court of Justice , which is primarily responsible for property law. In November 2004 he was appointed to the Federal Constitutional Court and was elected by the Federal Council on October 15, 2004. He succeeded the Federal Constitutional Judge Renate Jaeger . The judgments in which he was significantly involved include the decisions on the admissibility of contingency fees for lawyers (BVerfGE 117, 163), on the constitutionality of the smoking ban in restaurants (BVerfGE 121, 317; 130, 131) and on the ordering principle for housing brokerage ( BVerfGE 142, 268).

On November 8, 2016, Gaier resigned from his service as a federal constitutional judge after the end of his twelve-year term. On the occasion of his departure, he was awarded the Great Order of Merit of the Federal Republic of Germany with a star and shoulder ribbon by Federal President Gauck . Yvonne Ott , also from Hesse, was appointed as his successor in the First Senate of the Federal Constitutional Court .

Since August 20, 2008, he has been honorary professor at the Leibniz University of Hanover .

From September 1, 2019 to April 30, 2020, Gaier was the arbitrator of the arbitration board of the legal profession, which was established at the Federal Bar Association in accordance with Section 191f BRAO .

Gaier is married and has two children.
