The Standing Committee on Scientific Research and Fatwa Issuance ( Arabic اللجنة الدائمة للبحوث العلمية والإفتاء al-Ladschna ad-Dā'ima li-l-Buhūth al-ʿIlmīya wa-l-Iftā ' , DMG al-Laǧna ad-Dāʾima li-l-Buḥūṯ al-ʿIlmīya wa-l-Iftāʾ ) is an advisory office in Saudi -Arabia , which studies questions of Islamic norms ( Fiqh ) andissues fatwas . It is subordinate to the Council of Supreme Religious Scholars. Its task is to prepare studies and investigations which are then discussed in the Council. Another task is to be helpful to the population in answering questions. The most important writings of the committee are the two fatwa collections Fatawa al-Laǧna ad-Dāʾima and Fatawa Islamiyya .

history

The committee was introduced in 1971 under King Faisal with royal decree 137/1, its existence and necessity is justified by Article 45 of the constitution, in which the committee is explicitly mentioned. Under the former chairman of the committee, Abd al-Aziz ibn Baz , it came under heavy criticism from the local population and in parts of Muslim countries abroad, ibn Baz had the stationing of US troops in Saudi Arabia as part of the second Gulf War in the name of the committee considered to be legal and thus subsequently “approved” the decision of the Saudi government.

Sources and methods of legal finding

The committee is Sunni and uses the sources Koran and Sunna , but it does not apply the Sunni schools of law , it takes the view that one has to go straight back to the sources without considering the opinions of previous scholars - without going back to the ways of the schools of law to fall back on. Following a law school is neither a duty nor a recommendation, since every law school has right and wrong views and judgments. The greatest consensus among law schools on legal issues is achieved with the Hanbali . The views of the law schools are included in the argumentation if they support or share their own views. In accordance with the state religion in Saudi Arabia, the committee is strongly Salafist and politically royalist .

The decision on a legal issue depends on the majority in the committee; in the event of a tie, the opinion of the chairman decides.
