German Class Lottery Foundation Berlin
The Stiftung Deutsche Klassenlotterie Berlin ( DKLB-Stiftung ; also Lotto-Stiftung Berlin ) is a foundation under public law with legal capacity based in Berlin . It pursues charitable purposes. The purpose of the foundation is to grant grants for social, charitable, environmental protection, cultural, civic, youth-promoting and sporting projects. This is made possible by a legally regulated special purpose fee , which flows from the Deutsche Klassenlotterie Berlin (DKLB) to the foundation.
The DKLB Foundation has existed since January 1st, 1975; it was founded on the basis of the German Class Lottery Berlin Act and the German Class Lottery Foundation Berlin (DKLB Act) of June 7, 1974.
history
The Deutsche Klassenlotterie Berlin Foundation was founded in 1974. The basis for this establishment is the DKLB law of June 7, 1974. It came into force on January 1, 1975. With the establishment of the foundation, in particular, fixed framework conditions for the donation business should be created. The goal was u. a. to enable the foundation to build up its own assets and thus make the donations more variable. Before the foundation was established, the DKLB's surpluses were distributed by the advisory board. The advisory board was an organ of the DKLB with the task of distributing the surpluses from the lottery business for charitable purposes. In his function he was on an equal footing with today's board of trustees. As early as the beginning of the 1970s, three people appointed by the Senate and elected by the House of Representatives were included in the Advisory Board. Since then, the foundation has managed and distributed the funds available to it in accordance with Section 6 of the DKLB Act. It pursues charitable purposes and exclusively promotes social, charitable, environmental protection, cultural, civic, youth-promoting and sporting projects by granting grants. A statute was issued for the foundation on March 4, 1975 in accordance with Section 16 of the DKLB Act. It contains more detailed provisions on the use and distribution of the funds made available by the DKLB to the foundation on the basis of the legal basis.
task
The tasks of the foundation are laid down in Section 11 of the DKLB Act.
The foundation administers and distributes the funds available to it in accordance with Section 6 of the DKLB Act. The Deutsche Klassenlotterie Berlin is obliged to pay a special fee of 20 percent of the stakes and its net profit to the DKLB Foundation. The Foundation pursues charitable purposes; it exclusively supports social, charitable, environmental protection, cultural, civic, youth-promoting and sporting projects by granting grants. The formation of reserves is only permitted if this is necessary to achieve the stated purposes.
There is no legal entitlement to a grant . Donations to natural persons are only permitted for cultural purposes, provided the funded measure is made available to the public.
The foundation has to submit a proof of the distribution of the funds in detail for a calendar quarter to the House of Representatives for information.
With the approval of the Board of Trustees, the foundation can conduct other business in special cases.
Donations
Two types of grant can be requested from the foundation:
- Project grants are grants to cover expenses for individual defined projects.
- Institutional grants are grants to cover the entire expenditure or an indefinite part of the expenditure on the basis of a budget or economic plan.
The grants can be granted in the form of:
- Land, rights equivalent to land, buildings or movable property without reasonable consideration
- Loss coverage commitments or guarantees
- Loans or conditionally repayable benefits
- earmarked grants , debt servicing aid or other non-repayable benefits
Board of Trustees
An independent board of trustees decides which projects are supported by the Stiftung Deutsche Klassenlotterie Berlin . It consists of three members each appointed by the Berlin Senate and elected by the Berlin House of Representatives . The Board of Trustees is formed for the duration of the electoral term of the House of Representatives and remains in office until it is newly formed. It usually meets four times a year and advises on funding applications that have been submitted to the Foundation and assessed by the relevant Senate administration.
