UN Special Rapporteur on Extrajudicial, Summary and Arbitrary Executions
The Extrajudicial UN Special Rapporteur, summary and arbitrary executions (s: Special Rapporteur on extrajudicial, summary or arbitrary executions ) is since 1992 within the Human Rights Council of the United Nations ( UN existing) office to investigate extrajudicial (not ordered by a court) , summary executions (carried out in a fast-track procedure according to the standard law ) and arbitrary executions . The person entrusted with the task visits member states for this purpose and prepares annual reports.
The legal situation
The reporter on illegal executions is guided in his / her work by internationally recognized standards. The right to life is primarily determined in Article 3 of the Universal Declaration of Human Rights . In addition, there are Articles 6, 14 and 15 of the International Covenant on Civil and Political Rights . Paragraph 2 of Article 4 of the International Covenant on Civil and Political Rights provides that the right to life cannot be overridden in the event of a public emergency.
One of the most technical instruments for preventing unlawful executions are the principles adopted by the United Nations Economic and Social Council in its resolution 1989/65 of May 24, 1989. The fourth principle obliges governments to guarantee effective protection against unlawful executions.
The mandate
In resolution 1982/29 of March 11, 1982, the UN Commission on Human Rights recommended that the United Nations Economic and Social Council ask the chairman of the commission to appoint someone as special rapporteur for the 39th session on "summary and arbitrary executions " to report. This resolution was adopted as Resolution 1982/35. Since then, the client has been extended several times. Resolution 1992/72 broadened the mandate to include "extrajudicial" (extrajudicial) executions. The mandate applies to all states, regardless of whether they have signed relevant international agreements or not.
The Human Rights Council ( English Human Rights Council ), the Human Rights Commission replaced, asked in its resolution 03/08 of 2 May 2008. The Special Rapporteur u. a .:
- to submit annual reports to the Council and General Assembly of the United Nations on extrajudicial, summary and arbitrary (for short: unlawful) executions, to draw conclusions, to make recommendations and to draw attention to serious situations that require action to prevent further deterioration;
- respond effectively to information reaching him or her;
- improve dialogue with governments and follow up on recommendations made after visits to specific countries;
- to have a gender perspective in his or her work.
When performing the job, he / she should
- send urgent appeals to states at risk of unlawful executions;
- Make country visits to ascertain facts (en: fact-finding visits ).
By resolution 26/12 (June 26, 2014), the Human Rights Council extended the mandate of the Special Rapporteur by three years.
