Wilhelm Emil Wahlberg (born July 4, 1824 in Prague , † January 31, 1901 in Vienna ) was an Austrian lawyer and criminal lawyer .

Life

Wahlberg studied law in Vienna and completed his habilitation in 1851. In 1854 he was appointed associate professor and finally in 1860 full professor. From 1864 to 1872 he was a member of the Ministerial Justice Commission for drafting a penal code, with which he was also instrumental in the development of a reform of the penal code. He became a member of the State Court of Justice and the Criminal Law Commission. From 1874 to 1875 he was the rector of the University of Vienna . Wahlberg died on January 31, 1901 in Vienna and was buried in the Dornbacher Friedhof .

A particular concern for him were topics of criminal law and the code of criminal procedure as well as the execution of sentences. A main focus is on the question of sanity and the distinction between occasional crime and habitual crime.

He is considered to be one of the founders of the subjective view of criminal law and thus placed the lawbreaker at the center of consideration. Wahlberg saw in the punishment the possibilities of deterrence, prevention, improvement and security.
