Zurich commentary

from Wikipedia, the free encyclopedia

The Zurich Commentary is a series of legal commentaries that deal with Swiss civil law ( civil code , the law of obligations and subsidiary laws of the federal government ) and are published by Schulthess Legal Media .

history

The beginnings of the Zurich Commentary go back to the time when the two codifications of Swiss private law were created, to the Swiss Code of Obligations of June 14, 1881 and the Swiss Civil Code of December 10, 1907. In 1891 an edition was published for Swiss Code of Obligations, commented on by Albert Schneider and Heinrich Fick . This work can be seen as a pioneer of the Zurich Commentary. In 1909, two years after the Civil Code was passed on December 10, 1907 and three years before it came into force on January 1, 1912, the first volume on property law was published , commented on by Carl Wieland . This heralded the birth of the Zurich Commentary. The editors from the very beginning were August Egger , Arnold Escher , Hugo Oser , Alexander Reichel and Carl Wieland.

Since the founding time, the Zurich Commentary has been steadily expanded and with it the editorial committee, which was expanded from 1930 to 1936 by Robert Haab , Arthur Homberger , Alfred Siegwart and Federal Judge Wilhelm Schönenberger and in 1948 by F. Wolfhart Bürgi , Max Gutzwiller , Peter Liver , Werner von Steiger , Peter Jäggi and Werner Scherrer . This period was shaped, among other things, by the new edition of Egger's personal and family law, the commentary on property and land register by Arthur Homberger and the commentary on stock corporation law by Alfred Siegwart.

Due to the strong development in the field of private law ancillary legislation of the federal government, the question of opening up this area arose. The entry into force of the PILA on January 1st, 1989 gave rise to a first step in this direction. Since then, the relevant subsidiary laws have been integrated into the comment series and also commented on, such as the merger law and the partnership law .
