The Federal Anti-Discrimination Agency (ADS) is a federal authority that was established in 2006 in accordance with the requirements of the newly introduced General Equal Treatment Act . The task is to protect against discrimination against people on the basis of ethnic origin, religion / belief, sexual identity / gender, age and disability.

In terms of administrative organization and personnel law, the position is affiliated to the Federal Ministry for Family, Senior Citizens, Women and Youth , but its advice and professional work are independent of instructions and only subject to the law. The budget is shown in a separate chapter.

The head of the anti-discrimination agency is appointed by the Federal Minister for Family Affairs; Until 2018, the pedagogue and former employee of several state ministries Christine Lüders was in charge. Since then, the management position has been vacant and the anti-discrimination office is provisionally headed by Bernhard Franke. To carry out its tasks, the ADS has a staff of approx. 35 people who are organized into four sections: press and political planning, public relations and communication, research and policy matters, and advice. The CDU politician Barbara John has been chairwoman of the advisory board of the anti-discrimination agency since 2007 .

tasks

In addition to advising and supporting people who have experienced discrimination, the ADS conducts public relations work to prevent and eliminate discrimination. She also conducts research in collaboration with experts on the subject of discrimination and equal treatment. Every four years the ADS submits a report on discrimination to the Bundestag.

consultation

The office provides information about claims and the possibilities of legal action, arranges advice from other offices and, if representatives of the Federal Government or the German Bundestag are responsible, forwards to these representatives with the consent of the petitioners. At the request of the petitioners, the ADS also aims to mediate between the parties involved. According to its own information, the ADS has advised people in over 5600 cases since it was founded.

public relation

The ADS has issued a series of publications that are intended to raise people's awareness of the issue of discrimination, educate them about rights and give employers advice on how to implement the AGG. From November 2009 to January 2010, the ADS carried out the first nationwide campaign under the motto "Diversity instead of simplicity - together for equal treatment". The website is available in German and English, basic information is also available in other languages. All ADS publications can be downloaded or ordered from the official website.

research

In 2007 the ADS published the study “Discrimination in Everyday Life - Perception of Discrimination and Anti-Discrimination Policy in Our Society”, which Sinus Sociovision had prepared on behalf of ADS. For the first time, the study gives a milieu-specific insight into the attitudes of the population towards anti-discrimination policy and people affected by discrimination in society. As part of a series of expert reports to close research gaps, numerous legal expertise and research assignments are carried out, for example in connection with age discrimination and fundamental issues such as indirect discrimination, positive measures, multiple and intersectional discrimination or structural discrimination.

The management is appointed by the federal cabinet on the proposal of the Federal Ministry for Family, Seniors, Women and Youth. The management of the ADS is in a public service relationship, but not in a civil service relationship. The term of office of the management of the ADS ends with the meeting of a new Bundestag.

From February 2010 to May 2018 the position was headed by Christine Lüders. She previously headed u. a. the press, public relations and communication department in the Ministry for Generations, Family, Women and Integration in North Rhine-Westphalia. Most recently, Lüders was head of the public relations department and commissioner for foundations in the Ministry of Culture in Hesse.

Since May 2018

The management of the Federal Anti-Discrimination Agency is currently vacant. Bernhard Franke is acting head. Nancy Böhning's appointment as head of department was suspended due to a suit brought by a competitor.
