Axel Wirth

Axel Wirth (born March 15, 1951 in Augsburg-Göggingen ) is a German lawyer and former university professor .

Life

Wirth studied at the Ludwig Maximilians University in Munich , where he passed his state examination in law. He was in Berlin with a thesis on monetary policy and 1981 aid financing of the International Monetary Fund - (theme "Between monetary policy and development aid financing of the International Monetary Fund Altered task") doctorate . He then worked as a lawyer .

From 1999 to 2016 he was professor of construction law and holder of the first German university chair for German and international public and private construction law at the Technical University of Darmstadt . From 2000 to 2002 and from 2004 to 2006 he was the dean of the law and economics department there.

In addition to his teaching activities, Wirth works as an arbitrator , arbitrator and arbitrator . Since 2001 he has also been President of the Center for German and International Building Site and Civil Engineering Law. V. He is a co-founder and since 1999 an honorary member of the ARGE Construction Law in the German Lawyers' Association .

Allegations of plagiarism

In 2006 he was the author of parts of a commentary on the Civil Code . As a result, several newspapers reported that a large part of this article had been copied from Palandt's commentary . The publisher Luchterhand then withdrew the book. Wirth claims that the plagiarism came about solely through a doctoral student, who was only partially named as a co-author; he had not violated his “control obligations” and he could not be accused of “scientific misconduct”. The Technical University of Darmstadt set up a commission to investigate the allegation of scientific misconduct. The rector of the Technical University of Darmstadt then gave Wirth an official reprimand. After the allegations were discussed in a book in 2010, the interest group of German university teachers, the German University Association , asked Wirth to comment. Wirth rejected the statement that the association had started an exclusion process. He then announced his departure from the association. Wirth refers to a letter from the Technical University of Darmstadt from November 2010, in which his full support and appreciation is confirmed as a member of the university. In a letter dated November 2011, it finally states that, at Wirth's express request, it is confirmed "that the allegation made against you after the completion of the aforementioned procedure concerns organizational aspects". According to the presentation on a project website of the Handelsblatt, the ombudsman of the Technical University of Darmstadt at the time stated that Wirth had not committed any copyright infringement and could therefore not be prosecuted.
