Gerd Motzke

Gerd Motzke (born June 21, 1941 in Olomouc ) is a German lawyer. He was the presiding judge at the Munich Higher Regional Court , honorary professor and has made a special legal contribution to the field of construction law .

Life

Gerd Motzke was born in the Sudetenland and had to leave his hometown with his parents in June 1946. His family first came to Genderkingen in Swabia . Here he started school in a village school in 1947 and attended three primary school classes . After living in Bruck an der Mur , Austria, because of his father's professional activity , he returned to Germany, attended elementary school in Leipheim and then the upper secondary school in Günzburg (today Dossenberg high school). During the time at the secondary school, Motzke worked in summer jobs in construction. After graduating from high school in 1961, he began to study law at the Ludwig Maximilians University in Munich . In 1963/1964 he studied at the Free University of Berlin and completed his studies at the University of Würzburg in 1965 with the first state examination. He began his legal traineeship at the Karlstadt District Court and after one station moved to the Augsburg District Court district . In 1969 he passed the second state examination. During his legal clerkship he married in 1966. The marriage had two sons.

Gerd Motzke joined the Bavarian judicial service after completing his legal training and began his legal career as a judge at the Augsburg Regional Court in 1969 . From August 1971 to November 1972 he was employed as a public prosecutor and on November 17, 1972 he was appointed judge at the Augsburg Regional Court. On January 1, 1977, he moved to the law faculty of the University of Augsburg in the rank of government councilor . Here he taught students in working groups as part of the one-stage legal training . From 1978 he also worked as an examiner in the first state examination and began to train trainee lawyers in working groups. In 1980 he was with the work of the builders collateral mortgage on Peter Schlosser at Augsburg University doctorate . At the beginning of September 1980 he switched to the Augsburg public prosecutor's office and worked there as a group leader until mid-April 1982. On April 16, 1982 Motzke was appointed judge at the Munich Higher Regional Court. In 1990 he became an honorary professor at the University of Augsburg. On November 1, 1997, he was appointed presiding judge of the 27th civil senate of the Munich Higher Regional Court, based in Augsburg. The Senate deals with building matters.

Publications

Since 1979 Gerd Motzke has published articles in specialist journals, articles in anthologies and commemorative publications as well as monographs on building law topics. He edited sections in the collective work published by Friedrich Graf von Westphalen on the law of general terms and conditions . Motzke is co-editor of the first two editions of all three volumes of Beck's VOB Commentary , the only major commentary on the awarding and contracting regulations for construction services . Systematically, the comment was the first to comment on the VOB individually by number (now paragraphs) of the VOB.

Gerd Motzke is co-founder and co-editor of the New Journal for Construction Law and Procurement Law (NZBau), co-editor of the journal Der Bauträger (BTR) and member of the advisory board of the journal Der Bausachverektiven .
