The District Court of Inner City Vienna is an Austrian district court with its seat in the Justice Center Wien-Mitte in the Viennese district of Landstrasse . The federal government is the court holder . With over 40 judges, it is the largest district court in Austria and, due to its jurisdiction for the inner city district, is standardized as subsidiary jurisdiction in numerous laws if another court is not responsible or the competent court cannot be determined.
Jurisdiction
General jurisdiction
Like all district courts, the Inner City District Court of Vienna is also responsible for the following matters in its judicial district :
- Disputed civil proceedings with a value in dispute of no more than 15,000 euros , with the exception of commercial matters, here the jurisdiction lies with the District Court for Commercial Matters Vienna ;
- all marriage and family matters, permanent disputes, border and easement matters and property disturbance matters without prejudice to the value in dispute;
- most of the proceedings other than litigation, in particular family law matters (e.g. custody, maintenance), tenancy and home ownership matters, proceedings under the Heating Expenses Act and proceedings between partners (and their administrators);
- Executions;
- Bankruptcy matters other than those of people who run a business;
- Criminal cases for offenses for which only a fine or imprisonment of a maximum of one year is threatened;
- Land register matters.
Subsidiary responsibilities
Many federal laws provide that the District Court of Inner City Vienna has jurisdiction, if
- a person has no place of jurisdiction, domicile or residence in Germany or
- this cannot be determined.
The District Court of the Inner City of Vienna must then intervene instead of the competent court. Examples of such legal provisions can be found, for example, in the jurisdiction norm , the execution order , the Check Act 1955, the Death Declaration Act 1950 or the Marriage Act.
Special responsibilities
The District Court of the Inner City of Vienna maintains the register of maritime vessels for the entire federal territory.
For the head of the District Court of Inner City Vienna, due to the special position described, separate salary allowances are provided in the Judges and Public Prosecutor's Service Act.
Instance move
The District Court of Inner City Vienna is superordinate to the District Court for Criminal Matters Vienna and the District Court for Civil Law Matters , and a further appeal is made to the Supreme Court . The Higher Regional Court of Vienna oversees the administration of justice .
