Claus Asendorf

Claus-Dietrich Asendorf (born November 19, 1946 in Klingenthal / Sa. ) Is a German lawyer and former judge at the Federal Court of Justice .

Life

After Asendorf had finished his legal training, he initially worked as a research assistant at the chair for criminal law , criminal procedure law and legal philosophy with Ernst Amadeus Wolff at the Johann Wolfgang Goethe University in Frankfurt am Main . On April 1, 1977, he began his career as a judge by joining the judicial service of the state of Hesse . He worked there as a probationary judge at the Bad Vilbel District Court and the Frankfurt am Main Regional Court until he was appointed judge at the Frankfurt Regional Court in 1980. From 1983 to 1985 he was seconded to the Federal Court of Justice as a research assistant . On April 30, 1986, he became a judge at the Higher Regional Court in Frankfurt am Main , where he was employed in the special senate for patent law and industrial property protection and in the cartel senate. In 2001 Asendorf was appointed judge at the Federal Court of Justice. On December 31, 2009, he retired.

Asendorf was a member of the 10th Civil Senate of the Federal Court of Justice , which deals, among other things, with patent, utility model and topography protection law and public procurement law. In addition, from 2005 he was also a member of the Senate for Patent Attorney Matters and belonged to the Grand Senate and the Joint Senate of the highest federal courts . He shaped the highest court rulings on indirect patent infringement by drafting the judgments in the cases of drive pulley lift and automatic stretch hood . He wrote the judgments in the radiation control and microprocessor cases , which were used to clarify procedural issues relating to the patent process. Asendorf drafted the decision on procurement law, which for the first time allowed bidders to claim damages .

In addition to his work as a judge, Asendorf was also active in law, collaborating on a standard commentary on patent and utility model law and publishing it on competition and travel contract law . From 1997 he was also a lecturer for industrial property rights for engineers at the Technical University of Darmstadt .
