Georg Kodek

Georg E. Kodek (born November 6, 1963 in Vienna ) is an Austrian lawyer , judge and university professor . Kodek is Professor of Civil Law and Commercial Law at the Institute for Civil and Civil Procedure Law at the Vienna University of Economics and Business . Since 2006 he has also been a councilor of the Supreme Court .

Georg Kodek completed his Matura in 1981 with excellent results at the Fichtnergasse grammar school in the Hietzing district of Vienna . He then began studying law at the Law Faculty of the University of Vienna . He completed this in March 1986 with his graduation as a Magister iuris . Immediately after that Kodek began doctoral studies in Law and graduated in 1986/87 next to the court practice . In March 1987, he also included doctoral studies with the promotion to Doctor of Law and a PhD from the topic "Illegally obtained evidence in civil procedure" with distinction.

From November 1987 to August 1988 Georg Kodek completed the first part of the trainee judge training in the court district of the Higher Regional Court of Vienna . He interrupted this training from August 1988 to May 1989 in order to obtain the title Master of Laws (LLM) as part of a postgraduate course at Northwestern University in the US state of Illinois . In the summer of 1989, he completed an internship in the King's County District Attorney's Office , the office of the district attorney for the district of Kings County, which is congruent with the New York borough of Brooklyn . After successfully completing his American studies and internship and returning to Austria, Kodek continued his trainee judicial training from autumn 1989 to May 1991 and finally passed the judge's examination.

Georg Kodek received his first appointment as a judge immediately after completing the judge's examination in June 1991 when he was appointed judge at the Inner City District Court in Vienna. In July 1993 he was appointed judge at the Eisenstadt Regional Court, where he worked primarily as an appeal judge. After several expert and judicial activities, such as in the context of the training and further education of trainee judges and judicial officers, Kodek completed his habilitation in the fall of 2001 at the University of Vienna in the subject of civil procedural law with a habilitation thesis on the subject of “property disturbance proceedings. Material basis and procedural design of property protection ". From this point on, he also took on teaching and examination activities at the University of Vienna. On January 1, 2002, he was initially appointed chairman of the appeal panel of the Eisenstadt Regional Court, and a year later he was appointed judge at the Vienna Higher Regional Court.

On January 1, 2006, he was finally appointed Hofrat of the Supreme Court , the Austrian highest court for civil and criminal matters. Georg Kodek is a member of the sixth senate at the Supreme Court, a specialist senate for civil law matters with a special focus on corporate law matters. On October 1, 2007, Kodek was appointed full professor for civil law and commercial law at the Vienna University of Economics and Business . At the Vienna University of Economics and Business, he is currently head of the Department for Private Law and holds the chair of the Department for Civil and Civil Procedure Law II at the Institute for Civil and Civil Procedure Law. The textbook on civil law, which has been published since 2007, is particularly well-known by Kodek as co-editor and author together with Stefan Perner and Martin Spitzer .
