Harald Franzki

Hans-Harald Franzki (born October 27, 1924 in Breslau ; † July 25, 2005 in Celle ) was a German lawyer .

Life

His father was the lawyer Paul Franzki (* 1891; declared dead in 1947). After attending grammar school in Berlin, he took part in the Second World War from 1942, most recently as a lieutenant . From 1947 to 1951 he studied law and political science at the Technical University of Stuttgart and at the University of Göttingen .

Franzki joined the judicial service of Lower Saxony in 1955 . He was seconded twice to the Lower Saxony Ministry of Justice (1958–1960 / 1964–68). Until his retirement in 1989 he held numerous judicial offices . At the Higher Regional Court of Celle , of which he was president from 1976 to 1989, he sat before the senate for medical liability law . As an expert in expert law, he trained numerous, in particular medical experts.

He also devoted himself to legal historical research on German lawyers of Jewish origin . Franzki also dealt with the processing of the Nazi judiciary. However, this led to a dispute with the ÖTV trade union. After a meeting of the German Judicial Academy on Nazi Justice in December 1983 in Trier, Franzki was wrongly accused by the specialist group “Judges and Public Prosecutors in the ÖTV” of having counted down the number of Jews murdered in Auschwitz. This accusation does not correspond to the truth because Franzki said in his speech: “According to a confession by camp commandant Höss , around 2.5 million people are said to have been killed between 1942 and early 1944 alone. Here, however, there is the suspicion that his estimate was too high for incomprehensible boastfulness. After all, according to the judicial findings in Auschwitz, the number of victims is likely to be well over a million. ” Friedrich Karl Fromme , head of the FAZ's domestic affairs department with a special focus on legal policy, refuted this accusation in the FAZ in spring 1984.

Franzki took over numerous functions of the German Juristentag , which he headed as president in 1990 and 1992. Franzki was chairman of the permanent deputation from 1988 to 1993.

In 1990 he was awarded the Great Cross of Merit for his services .
