Hoffondsgut GmbH & Co. KGaA
Graf von Bassewitz was a partner in Hoffondsgut GmbH & Co. KGaA. Hoffondsgut supports former owners whose land in East Germany was expropriated after 1945 in asserting claims for compensation that the federal government grants them by law (Compensation and Compensation Act, EALG). The EALG provides for compensation in the form that previous owners can buy back a small part of their previous property from the federal government at a price below the market value. Hoffondsgut assists the previous owners with the application process and the purchase process, offers a model for financing the purchase price and, if necessary, takes over the lease management.
The NDR criticized the project in a report dated December 21, 2011. In it, Carsten Momsen from the University of Hanover was quoted as saying that Hoffondsgut needed approval from the Federal Financial Supervisory Authority (BaFin) because of its financing activities. However, after the business model has been adjusted and agreed with BaFin, the business model is no longer subject to the German Banking Act. The federal land utilization and management company BVVG, which is responsible for the sale of land, has expressly no legal objections to the Hoffondsgut project and will treat corresponding applications “like everyone else”.
