State Court of Hesse
The State Court of Hesse is the constitutional court of the State of Hesse. The court has its seat in the Hessian state capital Wiesbaden in an annex of the Hessian Ministry of Justice in the Luisenstrasse.
Constitutional foundations
The structure, responsibilities and procedures of the State Court are regulated in Articles 130 to 133 of the Constitution of the State of Hesse and in the law on the State Court. The State Court of Justice is a constitutional body of the State of Hesse. The State Court decides
- about fundamental rights lawsuits,
- on constitutional disputes,
- on the compatibility of Hessian laws and ordinances with the constitution of the State of Hesse,
- in procedures for referendums, referendums and referendums,
- Charges against a member of the state government,
- in the other cases assigned to him by law.
composition
The State Court of Justice consists of eleven members, five of whom have to be judges in the national service. Your election is made by an electoral committee, which consists of eight members of the state parliament and requires a two-thirds majority. The term of office of judicial members is seven years. The six other members of the State Court of Justice are elected by the state parliament with a simple majority at the beginning of each legislative period. Their term of office corresponds to the length of the legislative period. The re-election of the judges as well as the other members is permitted.

State Attorney's Office
The public prosecutor's duties at the state court are carried out by the public prosecutor's office .
The current state attorney is Monika Böhm from Marburg .
Eligible applicants
The application can be made by: a group of voters, comprising at least one hundredth of all voters of the people, the state parliament, one tenth of the legal number of its members, the state government and the prime minister.
history
There was already a state court in the people's state of Hesse during the Weimar Republic . Its legal basis was Article 50 of the Constitution of the People's State of Hesse and the law on the State Court of May 13, 1921 (Rbl. P. 99 ff.) .
