Roman Poseck (born March 16, 1970 in Mülheim an der Ruhr ) is a German lawyer . Since 2012 he has been President of the Higher Regional Court in Frankfurt am Main and since 2017 also President of the State Court of Justice, the constitutional court of the state of Hesse.

Life

Poseck studied law at the universities of Giessen and Utrecht . In 1997 he received his doctorate in Giessen with a topic on the criminal liability of supervisory board members. During his studies and afterwards he was a research assistant and research assistant to Professors Klaus Lange and Peter Cramer .

After working as a lawyer at BASF for a year , he became a judge at the Limburg Regional Court in April 2000 . Just one year later he was transferred to the criminal law department of the Hessian Ministry of Justice in Wiesbaden. In 2002 he was appointed judge for life and in 2004 he was appointed judge at the Higher Regional Court in Frankfurt am Main (with the continuation of his secondment). From 2005 to 2007 he headed the ministerial office of Jürgen Banzer , in 2007 he was promoted to senior ministerial councilor. As ministerial director he took over the management of the central department of the ministry (department head Z: Personnel, Budget and Legal Affairs) and was the permanent representative of the State Secretary.

On May 1, 2012, he became Thomas Aumüller's successor , President of the Frankfurt Higher Regional Court and at the same time chaired the 26th Civil Senate.

On January 25, 2017, he was elected by the Hessian state parliament without dissenting votes to succeed Günter Paul as the new President of the State Court of Hesse . The 103 members of the CDU, SPD, Bündnis90 / Die Grünen and FDP voted for him. The members of the parliamentary group of the Left abstained.

On April 2, 2019, the Hessian state parliament re- elected him as President of the State Court of Justice without dissenting votes on the proposal of the CDU , Bündnis 90 / Die Grünen , SPD and FDP . The members of the left abstained again. On the occasion of his swearing in, he highlighted the brand essence of the Hessian constitution in the state parliament and mentioned above all the principle of diversity and tolerance, the rejection of racism and exclusion as well as the commitment to Europe.

Since 2012 he has been a board member of the Frankfurter Juristische Gesellschaft eV and of the foundation "Rehabilitation Fund for Delinquents" Poseck has lectured in criminal law and criminal procedure law since 2001, from 2001 to 2013 he taught at the University of Police and Administration in Wiesbaden and since 2014 at the EBS University for Economy and law in Wiesbaden. There he was appointed honorary professor for criminal law and procedural law in October 2016.

Together with Heinz Georg Bamberger , Herbert Roth and Wolfgang Hau , Poseck is the editor of a commentary on the German Civil Code, which is also an online commentary (OKBGB). He is also the author of the international arbitration practice handbook by Hanns-Christian Salger and Rolf Trittmann

Poseck has lived with his family in Elz since 2002 . He is a member of the CDU .
