The EBS University for Economics and Law is a private , state-recognized university in Hesse . Until 2011 it was called the European Business School (EBS). From 2011, the university was criticized, among other things, for the misappropriation of funding. The university has been an indirect part of the SRH Holding association since 2016 .

history

The previous institution was founded in 1971 by Klaus Evard as a university of applied sciences in Offenbach am Main under the name European Business School . The original concept envisaged a European-style management training program with three locations in France, England and Germany. The EBS study program is characterized by several practical periods of study at home and abroad, integrated semesters abroad and a school-based structure of the course. In 1980 EBS moved to Reichartshausen Castle in Oestrich-Winkel in the Rheingau . In 1985 a second university building (the "Burg") was added in Oestrich-Winkel.

In 1989 EBS was recognized as a scientific university by the state of Hesse. In 1992 it was finally recognized as a scientific university by the Hessian Minister of Science. With this step, EBS Schloss Reichartshausen separated from the international association of European Business Schools , which had developed as a network in the 1980s. Since then, EBS has been cooperating with independent universities around the world. In 1993 she received the right to doctorate and in 1998 the right to qualify as a doctorate . During this time, Walther Leisler Kiep (CDU) was President of EBS.

The EBS Law School was founded on June 16, 2010 ; it is the second faculty after the EBS Business School . On September 1, 2011, the Hessian Ministry of Science awarded EBS university status and the title University of Economics and Law . The seat of the EBS Law School and the corporate seat of the EBS Universität für Wirtschaft und Recht gGmbH are located in Wiesbaden .

On July 28, 2016, SRH Higher Education GmbH , a subsidiary of the German education and health group SRH , took over the majority of EBS Universität für Wirtschaft und Recht from the private foundation for the promotion of EBS Universität.

The third faculty, EBS Executive School, was founded in December 2018 .

The EBS University of Economics and Law is sponsored by a non-profit company of the same name , the main shareholder of which has been SRH Higher Education GmbH since 2016 . The alumni association EBS Alumni e. V. called.

Education

The course includes around 15 bachelor's and master's degrees and doctoral programs, mainly in business and law disciplines. The tuition fees are around 8,000 euros per semester.

Accreditation

  • EQUIS (not accredited): Between 2012 and 2015, the EBS Business School was EQUIS -accredited. In 2015, the European Foundation for Management Development decided to refuse the EBS Universität für Wirtschaft und Recht its accreditation from EQUIS, but to allow the accreditation process to be repeated. In December 2016, the re-accreditation procedure finally failed, which is why the university has no longer had EQUIS accreditation.
  • FIBAA : All courses of EBS by the Foundation for International Business Administration Accreditation (FIBAA) accredited . In addition, the master’s course “MSc Automotive Management” at the EBS Business School and the bachelor’s course “LL.B.   • Accreditation by the Science Council : On May 29, 2012, the EBS Universität für Wirtschaft und Recht received institutional accreditation from the Science Council for ten years. Since 2017, doctorates in law can be taken at EBS Universität. In its accreditation report, the Science Council criticizes the fact that the granting of far-reaching privileges such as doctorate and postdoctoral qualifications made by the State of Hesse took place without a prior external quality check.
  • EBS Universität für Wirtschaft und Recht is a partner of the Association to Advance Collegiate Schools of Business ( AACSB ).

Economic development

In 2011 the university received 32.2 million euros (previous year: 32.1 million), of which 11.8 million euros came from tuition fees (previous year: 10.5 million). This contrasted with expenses of 33.4 (previous year: 34.3) million euros. The university generated a loss of 2.2 million euros in 2010 and 1.1 million euros in 2011. The equity end of 2010 was 1.45 million euros and had been nearly depleted, according to a media report 2011th At the end of 2012, the Hessian State Audit Office came to the conclusion that without a sustained injection of equity capital or equity-replacing loans, EBS would be “unable to prevent over-indebtedness and secure its solvency in the long term”.

According to President Rolf Wolff, the business school also made a loss in 2013. According to a report by the newspaper Die Zeit on February 2, 2014 on the economic situation of private business schools in Germany, EBS received fewer third-party funds and donations due to its battered reputation. The business school slipped deeply into the red despite the still generous state support. At 1.7 million euros, however, the loss in 2013 should have been significantly lower. Mainly because the university had imposed a strict austerity program and through the funding of several chairs by Aareal Bank and the food company Danone .

In 2016, SRH Higher Education GmbH, a subsidiary of the German education and health group SRH , took over the majority of the EBS University for Business and Law. In 2017, SRH Holding recorded sales of EUR 968.4 million.

Rent deferral due to risk of bankruptcy

In May 2013 reports from the FAZ and the Frankfurter Rundschau announced that the city of Wiesbaden had deferred EBS to pay the rent for the building it was using in Wiesbaden . A total of 400,000 euros in rent for the months from April to December 2013. Rainer Schäfer, the managing director of the municipal holding WVV, justified the deferral by stating that EBS was threatened with bankruptcy if the city did not comply.

After the economic situation of EBS remained critical in the course of 2013, the university asked the city of Wiesbaden in November 2013 to defer a further 188,000 euros in rent for 2014, which the city refused.

Waiver of wages and the resignation of the Chancellor

Since the rent deferral was an essential component of the continuation forecast, the employees had to forego the 13th monthly salary and bonus payments in 2013 and 2014 after the city of Wiesbaden rejected it. After employees had already waived bonus payments for 2012, the recent wage losses are said to have contributed to further employee losses.

On the same day that the rejection of the rental deferral became known, EBS announced that Chancellor Georg Garlichs would leave EBS on April 1, 2014. His successor as Chancellor, Olaf Güllich, left EBS seven months after taking office on October 31, 2014. Effective July 1, 2016, Peter Schmidt, former Managing Director Human Resources and Labor Director of the tourism company TUI Germany , became Chancellor of EBS Universität.

Downsizing of professorships

As a result of its tight financial investments, EBS has cut numerous professorships since 2010. After the exact extent of the cuts could only be speculated for a long time due to the lack of precise figures, the Hessian Science Minister Boris Rhein announced the following figures in October 2014 in the Hessian state parliament: From 46 professors at the Business School in 2010, the number of professorships fell in 2011 to 38, in 2012 to 34 and in 2013 further to 31. Under the new President Rolf Wolff , job cuts were pushed further as a result of the strict austerity measures, so that the number of professors at the business school fell to 25 in September 2014. At the same time, the university built up professorships with the second faculty, the EBS Law School, so that the total remained at a similar level:

By October 2019, the number of professorships at the three faculties had increased to over 70, of which 44 were core faculty members at the university (accredited senior and junior professors, lecturers and postdocs).

Financial development since 2014

The equity of EBS rose from minus 10 million euros in 2014 to plus 440,000 euros in 2015. This was made possible, among other things, by debt waivers by the banks as well as donations from alumni and the foundation of SAP co- founder Dietmar Hopp .

By 2016, equity increased to a total of 10 million euros, made possible by the sale to SRH. In 2016, the company recorded the "best operational result in the company's history". The annual profit was 1.98 million euros.

criticism

Alcohol abuse by college students 2010

Prospective EBS students were noticed in the immediate vicinity of the university in September 2010 due to excessive behavior as a result of excessive alcohol consumption as part of an admission ritual organized by advanced semesters. The police had to pick up several students, bring them to the hospital and search the Rheingau vineyards with a police helicopter. According to the FTD, the admission ritual called “Bootcamp” had existed for many years.

The university management has taken on the issue, imposed alcohol bans and introduced increased social obligations.

Start-up financing of the EBS Law School through tax money 2011

The establishment of the EBS Law School was to be supported by the state of Hesse and the city of Wiesbaden with an initial amount of 25 million euros. This was particularly criticized because at the same time the public universities had to accept savings. In April 2011 it was announced that the funding of 50 million euros should be twice as high as originally planned. In addition, the use of the tax monies already paid out remained unclear.

At the end of April 2011, the Ministry of Science announced that it would have the interim and usage records for state funding checked by a consulting company and that all funding funds would be frozen until then. As a result of the exams, EBS had to repay 950,000 euros to the country, which had been used for other purposes during the presidency of Christopher Jahns instead of building up the law school.

In a report to the state parliament at the end of 2012 , the Hessian State Audit Office questioned "the appropriate use of funds overall" and criticized the fact that "no reliable analyzes of the need for business-related legal training in Hesse and the establishment of another Hessian university were presented". It was also criticized that a large part of the grants were used instead of building the law faculty for general costs of the university. In December 2012, the state parliament then set up a parliamentary committee of inquiry to investigate the events.

During the investigation committee, the former commercial director Klaus-Peter Niesik, who was invited as a witness, admitted that the EBS had been embellishing and manipulating documents in order to obtain funding and thus engaged in “misuse of taxpayers' money”. Investigations into a possible “joint fraud to the detriment of the State of Hesse” by EBS amounting to at least 1.6 million euros led to another raid on the offices of executive employees on April 9, 2014. A total of four offices of EBS and searched the homes of three suspects.

The two related investigative proceedings against the accused and against EBS Universität due to an administrative offense according to Section 170 (2) of the Code of Criminal Procedure have been discontinued. This means that the Frankfurt public prosecutor's office has not found sufficient suspicion.

Use of funding at AIM 2011

In 2011, the EBS Automotive Institute for Management (AIM) also had to repay subsidies amounting to 60,700 euros due to non-use, and the Hessian Ministry of Economics examined another claim for a further 300,000 euros from 2010. In 2011, the institute headed by Franz-Rudolf Esch had to repay 60,700 euros to the ministry for funds that had not been spent as agreed, while the city of Frankfurt was reimbursed a further 31,300 euros. In the new exams it was u. a. about the fact that the managing director of the AIM was not employed there, but rather was given the opportunity to settle fees that were far too high. The managing director concerned, who is said to have left the institute on August 15, 2012, is considered a close companion of the former EBS President Christopher Jahns, who has meanwhile been accused of commercial infidelity and who founded the AIM together with him and EBS Professor Ronald Gleich .

Infidelity affair of former President Christopher Jahns 2011/2020

Research by Spiegel journalists Armin Himmelrath and Markus Verbeet in 2011 revealed the university's network of relationships with companies, in particular with the BrainNet advisory group. Its top manager Christian Rast sat on the foundation's board of directors, while EBS President Christopher Jahns was a member of the boards of several companies in the BrainNet Group. According to the report, connections between EBS and Jahns' corporate empire were extraordinarily close. According to a report by the Frankfurter Rundschau , Wiesbaden's mayor, Helmut Müller, was also involved in the affair. Accordingly, Müller, who is the supervisory board of EBS, gave BrainNet a consulting contract for the Wiesbaden Horst Schmidt clinics . For a 16-page report, 80,000 euros were billed. EBS President Jahns was also Chairman of the Board of Directors of BrainNet. Due to the allegations, the Federal Ministry of Research has postponed an EBS funding application.

The supervisory board of EBS gGmbH had initially rejected the allegations against Christopher Jahns. The connections were transparent and confirmed by auditors. Student spokespersons and representatives of the academic staff asked Jahns to disclose company relationships. Several professors then asked him in writing to renounce the office of president. On April 4, 2011, Christopher Jahns was arrested in Frankfurt on suspicion of infidelity, the detention was suspended subject to conditions. The university separated from him on April 7, 2011, and EBS announced eight terminations.

Jahns sued against these dismissals and reached a settlement with the university in September 2011. For his departure, he received a six-figure severance payment . Jahns initially challenged this settlement again in mid-August 2012 and filed a lawsuit because the university had withheld evidence, but withdrew the challenge and lawsuit shortly before the court hearing date. Jahn's successor, Rolf Cremer, criticized Jahn's leadership in return. For example, he operated a questionable financial and structural management, in which, among other things, almost a million euros in funding had to be repaid due to incorrect bookings and the presidium with its last nine managing directors had become unmanageable. Under Cremer's presidency, EBS reduced the number of managing directors to three.

In May 2012, the Wiesbaden public prosecutor brought charges against Jahns for commercial embezzlement, u. a. since the consulting firm BrainNet, whose board of directors was Jahns in addition to his position as EBS boss, charged the university for services that were never provided. The damage is estimated at 180,000 euros. Later, two university employees testify as witnesses that they helped initiate a “media campaign” against Jahns and leaked the material in question to the press, and the BrainNet boss exonerates Jahns. Ultimately, Jahns was found to have been charged with subsidy fraud for at least 1.6 million euros.

In October 2014, the proceedings against Jahns were temporarily suspended due to ongoing incapacity to stand trial. At the end of November 2018, the proceedings of the Frankfurt Public Prosecutor's Office against Jahns, the CDU state parliament member Walter Arnold and three former EBS executives were discontinued. After the capacity to stand trial again, however, a new criminal trial against Jahns will begin on March 19, 2020.

In May 2020, the proceedings against Jahns before the Wiesbaden Regional Court against the payment of 30,000 euros were discontinued after 9 years, whereby the presumption of innocence continues to apply.

Allegations of non-transparent contract research 2014

At the end of September 2014, EBS, together with TSG Hoffenheim, published the results of a scientific study that attested to TSG Hoffenheim, among other things, that it generates "seven times more income than public costs", that it is a "regional anchor of identity" that “83 percent of those surveyed are proud to be from Hoffenheim” and that the Rhein-Neckar Arena is considered “the second most important landmark right behind Heidelberg Castle”. However, research by the Frankfurter Rundschau revealed that the EBS chair, at which the study was carried out, is being financed by the TSG Hoffenheim patron, Dietmar Hopp , over five years with a total of 1.5 million euros. Not a single word was made of this connection, which casts doubt on the scientific independence.

In November 2015, EBS students published a satirical music video with which they took part in the application process for the annual WHU Euromasters, a sporting event for business schools. The video self-ironically shows a group of EBS students in exaggerated party scenes. After public criticism, this was withdrawn. After the video was deleted, the responsible students suggested doing community hours as a disciplinary measure.

Criticism of the self-image of the management academy

The elite researcher Michael Hartmann rejected the self-image of private business universities as a training center for top management. He analyzed the résumés of 440 board members of the 100 largest German companies and identified an EBS graduate among them, but three graduates from the state university of Paderborn, founded in 1972 . Hartmann also found that of 529 top managers, including foreigners, 28 have an MBA degree, which corresponds to a share of around 5 percent.
