Condom requirement

The condom obligation , also called condom compulsory, obliges the use of condoms during sexual intercourse in sex work as protection against HIV and other sexually transmitted diseases (STIs).

Germany

In Germany, with the Prostitute Protection Act in Section 32 (1), a general condom requirement was introduced nationwide for the first time from July 1, 2017 in the field of prostitution .

This was preceded by some regulations in various federal states . Bayern resulted in its regulation on the prevention of communicable diseases, effective 16 May 2001, condom compulsory for both male and female prostitutes and their free one. In 2009, the Augsburg Administrative Court dismissed the action brought by a brothel manager against the condom requirement in the publicly accessible rooms of her house. The condom requirement was introduced in Saarland in February 2014. In September 2014, the professional association for erotic and sexual services spoke out against the introduction of a statutory condom requirement because it was not possible to monitor compliance without unreasonable repression.

In the event of violations of the condom requirement, fines of up to 50,000 euros are provided for the customers; contrary to earlier plans, the prostitutes are not threatened with fines for violations of the condom requirement. Advertising for paid sexual intercourse without a condom is also prohibited in accordance with Section 32 (3) ProstSchG and can be punished with a fine of up to 10,000 euros ( Section 33 (3) ProstSchG).

United States

In the United States of America , the risk of HIV in the porn industry and in particular the HIV infection of porn actress Cameron Bay, which became known in August 2013, led to a rethink. In Los Angeles County , 2012, the condom duty was introduced in porn shooting, which is opposed by porn producers. In 2012, Steven Hirsch , executive director of Vivid Entertainment Group , announced that if condom-making became law, California would be leaving because films that use condoms would not sell. The deputy Isadore Hall brought in 2013 in California's parliament introduced a bill, which is to introduce the condom mandatory throughout the state of California. This was rejected.
