Martin “Bobbi” Stohler-Bader (born on October 21, 1914 in Basel ; died on October 5, 1966 in France ; legal resident in Basel and Pratteln ) was a Swiss lawyer , trade unionist and politician . He was a member of the Grand Council of the Canton of Basel-Stadt , co-founder and president of the Basel industrial workers section of the Swiss Textile and Factory Workers' Association (STFV) and president of the criminal court. He was known as an advocate for the common people.

Childhood, youth, studies

Martin Stohler was born in Basel as the son of the rector and social democratic politician Martin Stohler and Anna Stohler. He grew up in Basel, where he attended primary school and the humanistic grammar school. He then in Basel and Paris law studies and graduated in 1938 in Basel with the doctorate from. He then held several volunteer positions and did active military service . In 1942 he passed the bar exam. The following year he married his childhood friend Elisabeth Bader, with whom he had a daughter and a son.

Professional and political career

Beginnings and party split

Even in his youth, Stohler was involved in socialist circles. During his studies he belonged to the anti-Stalinist Marxist student group, which was supported by Trotskyists like Fritz Belleville and German émigrés from the SAP and KPO circles . In 1941 he was elected to the Basel Grand Council for the SP Basel-Stadt . After passing the bar exam, he opened his own law firm.

Stohler belonged to the left wing of the Basler SP. In February 1943 he belonged, among others with Carl Miville senior , to an opposition group in the party. This demanded a unified labor movement , namely a commitment to the legalization of the Communist Party of Switzerland (KPS) , cooperation with the communists in Basel and at the national level with the Nicolists . Alongside Miville and the president of the SP women's group, Clara Bächlin, Stohler played a central role in this group.

The party leadership of the SP Basel-Stadt called this grouping on May 10, 1944, to dissolve, not to disclose a her authored manifest and contacts with communists and the newly founded only in April 1944 Basel Party of Labor (PdA) to cut . The group did not meet these demands. On May 25, 1944, Stohler and seven other grand councilors of the SP voted together with the PdA against the validation of the grand council elections of March 1944, from which many supporters of the banned KPS were excluded. The party leadership then initiated an expulsion process against him and other representatives of the left wing. In June 1944 he was the other major Councils, who had voted against the validation and Government excluded Miville from the SP.

As he had previously announced, Stohler and the other excluded as well as other members of the party left joined the PdA afterwards. He then took a seat on the party executive of the PdA Basel and the PdA Switzerland.

Stohler was also secretary of the Society for the Promotion and Maintenance of Normal Relations between Switzerland and the Soviet Union, newly founded on February 6, 1944 .

In 1944, Stohler demanded the introduction of women's suffrage in the canton of Basel-Stadt in a suit. As a result, the third debate on women's suffrage after 1919 and 1927 took place in the Grand Council in December 1945. Although the government council and more than three-quarters of the grand council voted in favor, the draft developed after Stohler's initiative failed in the referendum on June 16, 1946.

post war period

Despite the party split in 1944, Stohler was elected President of the Criminal Court in 1946 with the support of the SP. In 1952, the SP presented its own candidate who was also supported by the bourgeois parties and the Landesring der Independen (LdU) . Against this, Stohler missed re-election in the second ballot. He then resumed his legal practice. In doing so, he earned a reputation as an «advocate for the common people» and «advocate for the people». He took on many small family or criminal cases, often also from poor workers and pensioners. He offered free weekly legal advice to the members of the Basel section of the STFV, which he presided over (from 1964 Textile Chemistry Paper Union [GTCP]).

Immediately after the Second World War , Stohler campaigned for the persecution of National Socialists , their sympathizers or representatives of an adaptive attitude in Basel. In June 1945 he called for the «cleansing of the canton from National Socialist elements». In February 1946, like Ernst Herzog, he used an interpellation to remove the Basel signatories from submitting the two hundred of their offices or to withdraw government contracts from them. He also unsuccessfully urged the government council to prevent Kurt Schuschnigg from appearing in public .

1950 and 1956 Stohler ran for the PdA in the government council elections, but was not elected. In the PdA, as before in the SP, Stohler took a critical stance. As early as 1948 after the breach of the Cominform with Tito, he protested against blind obedience. When he left the PdA in 1956 after the Hungarian uprising , he had long been part of the internal party opposition. One reason for the alienation from the PdA was the weight that it attached to individual freedom. The crimes committed by communist regimes were also incompatible with his ideas about socialism. In the Grand Council he resigned from the PdA parliamentary group together with four like-minded people and founded the “Independent Socialists” group. In the 1960 Grand Council elections he was able to win three seats with this group, while the PdA lost half of its previous 16 seats. This success was mainly based on the support of the chemical workers. In 1963 he returned to the SP.

Stohler also held numerous other offices. He was a citizen council , municipal councilor of Riehen and constitutional councilor.

Role in the trade union movement

Stohler played a key role in founding the STFV industrial workers section in Basel. The existing Basel section of the STFV lost its importance in the 1930s, was only active in the textile industry and in 1940 only had 135 members. At that time, companies in the Basel chemical industry did not tolerate any union involvement. Union workers were usually fired immediately. The organization of the Basel chemical workers was inspired by the draftsman and chemical worker Leo Loew, who made contact with the left-wing socialist group around Stohler. Stohler then used his connections to the banned KPS, which still had certain structures in the chemical workforce. Their secretary Marino Bodenmann promised him support. The new section was founded in 1941 with Loew as its first president. The STFV recognized the new group as the second Basel section alongside the existing one. Stohler was a member of the section's first board. After Loew was employed as a permanent secretary in early 1943, Stohler took over the presidency of the section, which he held until his death in 1966. The workers were finally organized through the existing communist factory group. Because of the company's anti-unionism and because the building of the section was viewed as a subversive activity of the communists, the work had to be done in secret.

After the difficult beginnings, the section grew rapidly. While the STFV, including the now insignificant textile section, had 1,010 members in 1942 and 1,888 in 1943, it was 4,364 in 1944, 7,420 in 1945 and in 1946 the highest level of 10,412 was reached. The new trade union section thus contributed the lion's share to the strong growth of the Basel trade unions during the Second World War. In 1946, the Basel section of the STFV was the largest trade union section in Switzerland. Stohler had made a decisive contribution to this success. He awakened hope in many chemical workers and created enthusiasm with his combative demeanor. During the conflict in the Basel chemical industry, Stohler temporarily took part in the negotiations on a collective labor agreement that were concluded in early 1945. This collective employment contract is considered a milestone in Swiss social history. Even if there were previously collective contractual arrangements between employers' associations and unions in the chocolate industry and on a regional level in the watchmaking industry, the contract in Basler Chemie was the first collective labor contract that uniformly regulated working conditions for an important export industry through negotiations between the two parties .

Stohler was also a board member of the Basel-Stadt trade union cartel for many years. Most recently he was its vice-president until his death. He was also a member of the central board of the STFV.

In the labor movement, Stohler was called "Bobbi".

Stohler died surprisingly a few days before his 52nd birthday and before the 25th anniversary of the GTCP Industrial Workers Basel section, which he helped to build, during a holiday in southern France and only three weeks after the equally surprising death of cartel secretary Oreste Fabbri. His death was noted with great regret not only in the labor movement but also in the bourgeois press. He found his final resting place in the Hörnli cemetery .

The long-time section administrator Traugott Hasslauer read out the speech he had prepared for the anniversary celebration, “Bread and shares alone are not enough”. In it, Stohler criticized conservatism, complacency and the fragmentation of the unions. The trend to employ more and more employees as salaried workers instead of manual workers is a danger for the trade unions and the social partnership. The trade unions will therefore have to fight over responsibility for employees. The artificial barrier between workers and employees must disappear. In addition, the agreements of the social partners should only benefit their members and not, for example, the unorganized workers.

Stohler also expressed similar considerations a few days before his death at the GTCP Association Congress from September 30 to October 1, 1966 in Lucerne in response to a lecture by SMUV Central President and SGB Vice President Ernst Wüthrich. This contribution to the discussion received a lot of attention. Stohler then expressed his surprise and joy that he had not been fought by Wüthrich, who was politically far from him.
