medsonet. - Professional association for the health service - is a non-tariff-compatible workers' association in the Christian Trade Union Confederation (CGB) and was founded on March 5, 2008 in Fulda. The office is located at the headquarters of the CGB trade union DHV - Die Berufsgewerkschaft (DHV) in Hamburg . In the statutes of March 5, 2008, Medsonet saw itself as a union of workers in all areas of health and social services. In April 2013, Medsonet ceased collective bargaining and no longer sees itself as a union but as a professional association . The chairman of the board is Jörg Schulze.

Collective agreements

On July 7, 2008, Medsonet and DHV signed a company collective agreement with the Freiburg municipal foundations. The Board of Trustees announced on June 20, 2007 that it would terminate the collective bargaining agreement for the public service (TVöD) at the end of 2007. The collective bargaining with ver.di failed in March 2008.

On October 20, 2008, Medsonet signed a federal collective bargaining agreement for employees in private clinics with the Federal Association of German Private Clinics. In September 2006, ver.di broke off collective bargaining. As a result, DHV concluded a corresponding collective agreement on December 15, 2006.

Just a few months after it was founded on March 5, 2008, medsonet came under fire: According to ver.di, medsonet was founded after the Hamburg Regional Labor Court ruled in March 2008 that the DHV had no collective agreements for most occupations in the social and health sector can complete. ver.di claims that through the management of the Red Cross - Blood Service West in Hagen employees would compelled to enter the DHV or medsonet. In fact, on a voluntary basis by mid-2010, 60% of employees had already made the DHV / medsonet tariff the basis of their employment contract. Another 30% have chosen the ver.di in-house tariff that applies in parallel.

Withdrawal of tariff eligibility

On May 17, 2011, the Hamburg Labor Court ruled that medsonet is not a union that is subject to collective bargaining agreements due to its small number of members (7,000 members according to its own information in the proceedings; corresponds to a degree of organization of around 0.32%). This was confirmed by the Federal Labor Court on June 11, 2013 (Az .: 1 ABR 33/12). This means that all collective agreements concluded by medsonet are ineffective.
