Michael Wurm

Michael Wurm (born October 5, 1945 in Welschen-Ennest ; † September 1, 2016 in Russe , Bulgaria ) was a German lawyer who was a judge at the Federal Court of Justice from 1988 to 2008 .

Life

Michael Wurm was in 1965 at the high school Theodorianum in Paderborn the High School , completed his subsequent legal training with the second state exam in 1972, and received his doctorate for a legal history subject at the University of Muenster . His career in the judiciary began that same year. He first worked at the Paderborn Regional Court and the Essen District Court before he was appointed judge at the Paderborn Regional Court in 1975. From 1977 to 1980 Michael Wurm was seconded to the Federal Court of Justice as a research assistant. In 1981 he was appointed judge at the Hamm Higher Regional Court and in 1988 he was appointed judge at the Federal Court of Justice. At the Federal Court of Justice he was until he was prematurely retired at the end of 2008 on application, in the III. Civil Senate of the Federal Court of Justice . Most recently he was deputy chairman of the Senate.

Michael Wurm shaped the jurisprudence on official liability and compensation claims in public building law , for example on the liability of municipalities in the event of contaminated sites on land or to "protected third parties" when issuing building permits . He was significantly involved in the development of the case law on the State Liability Act of the GDR and in the first foundations for the development of case law on § 839a BGB . He wrote the preliminary ruling before the European Court of Justice in the Brasserie du Pêcheur case .

In Staudinger , a legal commentary on the German Civil Code, Wurm commented on Sections 839 and 839a of the German Civil Code.

He died on September 1, 2016 in Russe (Bulgaria) as a result of a sudden illness during a Danube cruise.
