Legal assistant

Legal clerk in Germany is a state-recognized training occupation with a training period of three years ( §§ 1 and 3 ReNoPatAusbV). The training includes all work that occurs in a law firm . Until 1995, the official job title was legal assistant .

The training occupation is regulated in the ordinance on vocational training for legal assistant, notary assistant, legal assistant and notary assistant and patent attorney assistant (ReNoPat Training Ordinance - ReNoPatAusbV). The apprenticeship period can be shortened in the vocational school with appropriate previous training and good performance .

A certain educational or vocational qualification is not a prerequisite for access to the apprenticeship occupation, mostly an intermediate educational qualification or high school diploma is required. The training contract is concluded between the lawyer and the trainee, who is entered in the register of vocational training relationships by the competent bar association .

The training remuneration is regulated in Section 17 of the Vocational Training Act. The regional chambers can set minimum rates for training remuneration. In the district of the Munich Bar Association , the following recommendations have been in effect since January 1, 2017:

  • 700.00 euros in the 1st year of training (basic training),
  • 800.00 euros in the 2nd year of training (specialist training) and
  • 900.00 euros in the 3rd year of training.

The training includes all work that occurs in a law firm. This includes, for example, file management, client reception and telephone calls, resubmissions, handling of correspondence after dictation or independently (justification of claims, replies to complaints, filing of complaints), monitoring of appointments, calculation of deadlines (appeal, auditing), bookkeeping and cash management, keeping the appointment calendar , preparing client meetings and foreclosures (seizure, execution of furniture) and the organization and accounting of business trips.

On September 30, 2012, 4161 new training contracts were concluded in Germany. On the 2012 ranking of apprenticeships according to new qualifications in Germany - women - the apprenticeship occupies 14th place in the old federal states and 17th in the new federal states (including Berlin ).
