According to the United Nations Convention on the Law of the Sea, Germany has to take the measures necessary to ensure safety at sea for ships flying its flag . In addition to other requirements, this also applies to the manning of ships, which is stipulated in the ship manning ordinance .

Each ship must be manned by a captain , and appropriate officers and engineers with appropriate qualifications, as evidenced by the appropriate patents . The number and qualifications of the crew with regard to seamanship, navigation , communications and marine engineering must correspond to the type of ship, the size of the ship, the machinery and the equipment of the ship.

For this, every ship must be provided with a manning certificate or an equivalent document. The ship's manning certificate is issued by the See-Berufsgenossenschaft . The requirements regarding the citizenship of the crew members are to be noted in German and English in the ship's manning certificate.

The details are stipulated in the "General administrative regulations according to § 4 of the Ship Occupation Ordinance of December 30, 1998 in the version of January 21, 2004".
