The Implementing Regulation (EU) no. 923/2012 establishing common rules of the air and operational provisions for services and procedures of air traffic control (short English Standardized European Rules of the Air , SERA ) is within the EASA -Staaten the central rules on the behavior of participants in the aviation sector.

The main goals of the SERA are the harmonization of the air traffic rules in European airspace, the facilitation of the free movement in the European airspace, the simplification of the implementation of the functional airspace blocks as well as the support of the EU member states in their obligations towards the ICAO .

Background and story

As Standardized European Rules of the Air  (SERA) is called for the European airspace standardized flight rules. To this end, the European Commission commissioned the European Organization for the Safety of Air Navigation  (EUROCONTROL) to develop common standards in close cooperation with the European Aviation Safety Agency  (EASA) .

The aim is to introduce standardized functional airspace blocks (abbreviation FAB, from English functional airspace block ), which enable an aircraft to move freely across European borders, increase safety, abolish impractical rules and dangerous misunderstandings due to differing flight rules be reduced.

The scope of the mandate is limited to the Single European Sky set of rules and some parts of the basic EASA regulations. It comprises the ICAO Annex 2 Rules of the Air and other relevant ICAO standards and practices, the Standards And Recommended Practices  (SARPs), as well as procedures for air traffic control , the Procedures for Air Navigation Services  (PANS).

The SERA stipulations are contained in the Implementing Regulation (EU) No. 923/2012, which is valid from December 5th. The implementing rule should not create new obligations, but rather implement existing obligations. It standardizes how the existing ICAO obligations are to be implemented within the single European sky.

After an analysis, SERA should be developed in successive phases. The first is the implementation of ICAO Annex 2 Rules of the Air , named as SERA Part A . The following phases consist of the SERA parts B and C for the implementation of the measures defined in ICAO Annex 11 and possible other ICAO regulations. If necessary, a corresponding package is added because of the differences between EU and ICAO regulations.

At its 40th session, the Single Sky Committee agreed that a formal opinion on Part A would be delivered along with the vote on Part B.

As of 2014, the SERA regulation comprises ICAO Annex 2, Annex 3 and Annex 11; Annex 10, SUPPs 7030, DOC 4444 will follow as Part C , which will, however, be incorporated into the SERA.

The SERA regulation regulates the behavior of participants in air traffic, i. H. amongst other things:

  • Definitions (Art. 2), dimensions and units, time (SERA.3401)
  • Rules: General rules (SERA.3001 ff) and for
    • Minimum altitude (SERA.3105), cruising altitude (SERA.3110, Appendix 3), air restricted areas and restricted flight areas (SERA.3145)
    • Avoidance of collisions (SERA.3201 ff, SERA.11015): Approach, pre-flight rules, evasive rules, collision avoidance
    • Visual flight and instrument flight (SERA.3220, SERA.5001 ff)
    • Flights over the high seas (SERA.1001)
    • Flight operations on and around an airfield (SERA.3225)
    • Special cases, such as dressing flights (SERA.3135), unmanned free balloons (SERA.3140, Appendix 2) - and for tows, parachuting, u. a. as a reference to other rules
    • Emergencies (SERA.11010) and similar exceptional situations
  • Air spaces (SERA.6001, Appendix 4)
  • Flight plans (SERA.4001 ff)
  • Air traffic control procedures and services ( air traffic control , flight information service , among others; SERA.7001 - SERA.10001, annexes 4, 5)
  • Weather service (SERA.12001 ff)
  • Signals and signs (SERA.3301), this includes the ground signals, warning signs and instructions from technology / maintenance (especially Appendix 1); Lights to be guided by aircraft (SERA.3215)

National implementation

Germany

This regulation largely replaces the former German air traffic regulations . The air traffic regulations were amended in a shortened version on November 29, 2015.

The SERA regulations largely correspond to those of the air traffic regulations until 2014. Some of the relevant changes for German aviation are:

  • It is possible to fly at dusk without position lights. Twilight is around 40 minutes before sunrise and after sunset (sun up to 6 ° below the horizon)
  • Flight plan obligation in airspace C and D (submission also by radio, so in practice corresponds to the previous regulation)
  • Cloud distances 300 m vertical, 1.5 km horizontal in the CTR and in airspace G from 3000 ft or 1000 ft above ground (previously: free of clouds)
  • Flight visibility 8 km only from FL 100 in all airspaces (previously in airspace E also below FL100)
  • Flight visibility 1.5 km only up to 3000 ft or 1000 ft above ground (previously in the entire airspace G, i.e. up to 2500 ft)
  • The airspace F is replaced by the Radio Mandatory Zone (RMZ)

Austria

In Austria, SERA was implemented through the LVR amendment 2014 (Federal Law Gazette II 297/2014) and numerous changes in the AIP on December 11, 2014.

Important changes and differences to the SERA are:

  • In visual flight, the hazard potential of industrial plants is no longer mentioned
  • Parachute jumps are not flights within the meaning of the regulation, although a (main) parachute is an aircraft; Exceptions to the visual flight rules apply to hang gliders and paragliders, hang sailing and flights to ward off hail
  • Approval to fall below the minimum height is also required for bridges and similar structures, as well as braced ropes and wires (except for ambulance, rescue flights, etc.)
  • A flight according to instrument flight rules also applies to high terrain or in mountainous areas
  • Visual flight rules apply at night within the scope of the flight plan, and with slightly changed minimum visual weather conditions and altitude
  • various new regulations for special flights according to visual flight rules in control zones (SVFR)
  • RNAV required for flights above 9500MSL
  • Rules for flights under instrument flight rules outside of controlled airspace
  • Details on the validity of the flight plan
  • Areas with mandatory radio communication (RMZ): LOAN , LOAV
  • Areas with mandatory transponder (TMZ): Vienna and Innsbruck
  • Transponder Mode S with pressure altitude transmission for all aircraft (with rigid wings, helicopters and gyrocopter; transition period until December 31, 2017)
  • Safety zones and prohibitions for the operation of model aircraft , unmanned aircraft of class 1 and civil aviation equipment that can be used independently in flight (" drones ")
