Tilo Berlin

Tilo Berlin (born November 17, 1958 in Hanover ) was CEO of Hypo Group Alpe Adria from June 1, 2007 . He played a key role in the sale of the majority stake in Hypo Group Alpe Adria to BayernLB .

Berlin grew up in Vienna. After graduating from high school and studying law at the Universities of Salzburg and Vienna, followed by a doctorate, he took on his first positions in finance at Deutsche Bank AG , where he ultimately headed corporate planning after various positions. In 1993 he was appointed to the board of the Landesgirokasse Stuttgart and later to the board of the Landesbank Baden-Württemberg . In 1999 he became a partner at MM Warburg & Co. in Hamburg. In 2002 he founded Berlin & Co. AG , a family office provider.

In April 2009, Berlin left the board of the Hypo Group Alpe Adria because of different opinions with the majority owner regarding the corporate strategy . As part of the Tilo Berlin Carinthia Foundation , under the direction of economic expert Fredmund Malik , urban development concepts have been drawn up since December 2009.

Via the former B & Co private foundation (today: Mons Carantanus private foundation, based on the Carinthian Ulrichsberg ), Tilo Berlin was one of the founders of the investment vehicle in the tax haven Luxembourg, Berlin & Co Capital SARL Luxembourg. This Luxembourg-based Berlin company takes over a 4.5 percent stake in Hypo Alpe Adria in December 2006 for 125 million euros. In the following year, it increased its stake for a further 125 million euros and subsequently held a blocking minority in the bank, which it passed on to BayernLB at a profit in 2007 . The Munich public prosecutor's office, headed by Chief Public Prosecutor Hildegard Bäumler-Hösl, examines the sale of Kärntner Hypo to BayernLB, in which the Berlin & Co group earned 150 million euros within a few months. Since January 2010, the investigation has been extended to Tilo Berlin himself and other people.

Berlin has been married to Filippa, née Goëss , from Carinthia since 1986 and has three children with her. He lives with his family at the Ulrichshof, which is located on the Carinthian Ulrichsberg, and runs an organic farm there.

Hypo Alpe Adria scandal

In 2014 he was sentenced to 26 months in prison as the ex-boss of Hypo Alpe Adria . Berlin and other bank managers were accused of concealing important information about the capital resources of the Austrian institute when the Kärntner Bank was sold to BayernLB . At the end of February, three other ex-Hypo board members had already been sentenced to several years in prison. At that time Berlin could not appear for health reasons. His lawyer has appealed to the Supreme Court (OGH). In October 2015, the General Procurator recommended that the Supreme Court confirm the judgment against Berlin. The subject of the proceedings is also a special dividend which, in the opinion of the court, was paid out contrary to the statutes. The opinion of an auditor commissioned by the Klagenfurt Public Prosecutor's office relieved Berlin of this suspicion in November 2015, as it was unable to find sufficient evidence to confirm the allegation.

In April 2016, the Supreme Court partially overturned the first instance judgments. In the opinion of the court, the findings made by the lower court were not sufficient to confirm the allegation of unfaithfulness. In the repetition of the proceedings on March 16, 2017, Berlin was not legally sentenced to 14 months imprisonment by the Klagenfurt Regional Court, of which ten months were conditionally pronounced.
