Ulf Börstinghaus

Ulf Peter Börstinghaus (born July 13, 1955 in Gelsenkirchen ) is a German judge and author .

Life

Börstinghaus was born in Gelsenkirchen in 1955. After graduating from the Schalke school in Gelsenkirchen in 1975 and the 15-month military service , he studied from 1976 to 1981 at the University of Bochum law . He is married with two children and two grandchildren. His daughter Cathrin has published legal books and articles, either alone or with Börstinghaus, e.g. B. the rent reduction table, 4th ed.

Career

After completing his legal traineeship at the Regional Court of Bochum , he initially worked as an employed lawyer from May 1984 to October 1986 . He was appointed judge on November 1, 1986 and has been a judge at the Dortmund District Court since September 1988 . Since then, he has been the head of a general civil department and, since 1994, also a WEG department. In September 2016 he was appointed another supervisory judge at the district court.

Börstinghaus is a founding member of the German Tenancy Court Conference and was its chairman from 1997 to 2017. He has been honorary chairman of the association since 2017.

In 2012 he did his doctorate at the University of Bremen on "Area deviations in housing rent". In 2015 he was appointed honorary professor by the Law Faculty of Bielefeld University . He is a permanent speaker at various specialist training courses, for example since 1995 as a lecturer at the German Judicial Academy and state justice administrations and at seminars for the legal profession and the housing industry.

Expert in the legislative process

Börstinghaus has been heard several times in the legislative process by the Legal Committee of the German Bundestag . On October 15, 2012, there was a hearing on the draft law on the energetic modernization of rented living space and on the simplified enforcement of eviction titles (Tenancy Law Amendment Act - MietRÄndG) and on December 3, 2014 on the tenancy law part of the draft law to dampen rent increases to strained Housing markets and to strengthen the customer principle in housing brokerage (Tenancy Law Amendment Act - MietNovG).

Honor

In 2019 he was awarded the Federal Cross of Merit. On the occasion of his 65th birthday, Markus Artz , Norbert Eisenschmid, Hubert Schmidt and Elmar Streyl published the commemorative publication "Facets of Tenancy Law" in Beck-Verlag.

Börstinghaus is co-editor of the New Journal for Tenancy and Housing Law (NZM). Since the 7th edition he has been commenting on tenancy law in the standard Schmidt-Futterer commentary on tenancy law. ISBN 978-3-406-73125-9 , the rental level regulations and, since 2015, the rental price control regulations. After Hubert Blank's death in 2020, he took over the editing of this standard commentary from the 15th edition. Together with Hubert Blank he has Beck's short commentary rental.
