Wolfgang Schmidt-Futterer (born October 4, 1927 in Silesia ; † April 2, 1978 ) was a German civil judge at the Mannheim Regional Court and specialized in tenancy law .

Life

During the Second World War he passed his secondary school diploma and was then drafted into the Wehrmacht for service at the front . There he suffered burns that led to blindness in both eyes. Despite the limited academic career opportunities, he began studying law at the University of Göttingen . After the first state examination , he moved to Mannheim . There he passed his assessor exam and entered the Baden-Württemberg judicial service . He worked as a civil judge at the Mannheim District Court until the end of his life.

As a member of a board of appeal and appeal, he dealt with tenancy law, among other things. He earned a reputation as an expert in this area of ​​law through articles in specialist journals . In the 1970s he was considered one of the best experts on German tenancy law ( "Tenancy Law Pope" ).

Wolfgang Schmidt-Futterer has written several books on tenancy law, e.g. B. Beck's legal encyclopedia "Tenancy Law" (1969), which was reprinted annually and of which around 100,000 copies were sold during the author's lifetime. With "Miet und Lacht" he published a popular scientific work on this subject from 1972 onwards .

His most important work is the commentary "Housing Protection Laws" , published in 1974 for the first time . The reason for this was the reform of tenancy law by the social-liberal government . Schmidt-Futterer was politically independent, but was close to the ideas of social democracy . He therefore wanted to develop a scientifically sound commentary to show that socially structured private law can be reconciled with market economy conditions. This earned him the derogatory term "red Wolfgang" from opponents. Nevertheless, the work was enthusiastically received in practice and quickly developed into a standard commentary. Even after Schmidt-Futterer's death, the comment was continued under his name. The "Schmidt-Futterer" was last published in 2019 in its 14th edition.

Wolfgang Schmidt-Futterer died on April 2, 1978 of sudden heart failure . The German Mietgerichtstag awards in his honor annually since 2003 and worth 4,000 euros Schmidt-Futterer Prize for outstanding scientific monographs with mietrechtlichem focus.
