Public intercourse

Sexual intercourse that takes place in public space or is freely viewable from there can be referred to as public intercourse or sex in public .
In addition to public places such as shopping centers, underground stations, public transport and toilets, this definition also includes easily visible private spaces. Office space and a car parked in public spaces are also included; as well as remote places such as backyards, gardens, cemeteries, forests or beaches.
Depending on the situation, it can be, for example, conscious exhibitionism , uninhibited actions in a state of intoxication (e.g. caused by alcohol) or an allegedly private situation that can, however, be observed in public.
Historical examples
As early as 374 BC, the Greek hetaera Neaira reported that she had sex with Phrynion in front of an audience, which was perceived as at least improper. The Thracian Hipparchia was also said to have public sex acts due to her cynical background.
In the 17th century, laws of European culture usually provided severe penalties for fornication . A distinction as to which practices were socially acceptable varied greatly from place to place; Punishments ranged from social exclusion and flogging to the death penalty. Public masturbation or sodomy (which included anal intercourse) in general could be punished by death because of the religious prohibition.
An example of an exception was apparently the pre-colonial society in Tahiti , where European explorers met locals, for whom public intercourse was not subject to any social taboo. The tales of the astonished and enthusiastic seafarers of the exotic dances and generous girls they had met formed the romantic idea of egalistic, pacifist South Seas natives (a form of the noble savage ) in Europe . In fact, Tahiti had a social class system; there were wars and ceremonial human sacrifices. Horrified missionaries later spoke of a "filthy Sodom of the South Seas", the inhabitants of which constantly spoke of " the wretched union of the sexes".
In the homosexual subculture from the 19th century onwards, sex in publicly accessible, but shielded places such as toilets ( hatches ) was a practice in order to anonymously pursue tendencies that were not socially accepted.
In September 2003 the BBC reported on the widespread practice of dogging , which in British English means sex in public green spaces or parking lots - in numerous cases in the presence of spectators. Groups with tens of thousands of members have already formed via social networks, and sex often occurs with completely strangers. These practices of the swinger scene carry an increased risk of the transmission of sexually transmitted diseases and a dogging scene in certain places leads to fear of increased activities of the drug and prostitute milieu. A warning should also be given against the abuse of Rohypnol . However, these practices have become established in numerous other countries.
As a result of filming of public sexual intercourse in underground trains and at underground stations in Vienna (2010 and 2014) and Berlin (2014), incidents received some international media coverage. Even without stressful video recordings, incidents regularly cause a stir and are prevented by the police if necessary.
According to a non-representative survey carried out in the USA, 22 percent of the participants in 2005 said they had had sex in public. The search for thrill is named as an important motivator for living out the widespread fantasy situation . Most of the situations would not repeat themselves and those involved would not expose themselves to the uncomfortable situation again.
Legal situation
Sexual intercourse in public is not generally prohibited in Germany. Only when a third person sees himself directly harassed by the act is public sexual intercourse as an administrative offense or arousing public nuisance under Section 183a of the Criminal Code now a punishable offense. In Austria, § 218 StGB also provides for fines or imprisonment. In Switzerland, acts according to Article 198 StGB are punishable by a fine.
In practice, consensual sexual acts can be prosecuted by the police in German-speaking countries as soon as someone reports a complaint. Usually the police do not conduct their own investigations without a corresponding report.
In Great Britain, too, the acts fall under different legal aspects; In most cases, the decisive factor is whether, depending on the place, time and public traffic, there is an “ outraging public decency” . Sexual acts in public bathrooms are prohibited under criminal law. Against the historical background of the earlier persecution of homosexuals, the guidelines of the police only provide for intervention depending on the situation, for example when reporting a harassed person. Places that are informally classified as Public Sex Environment are rarely evacuated.
Stricter laws usually apply in the USA: Public indecency , indecent exposure and disorderly conduct are prohibited, but these prohibitions are heavily dependent on the legal situation in individual states and on the legal interpretation of the investigating authorities and courts. A prominent case in 1995 was the sentencing of actor Hugh Grant to a fine and suspended sentence for having oral sex with prostitute Divine Brown in his vehicle .
Motif in art
As an artistic and literary motif, the fantasy of the public act of love has been worked out many times, especially in the field of pornography and erotic literature . The British singer-songwriter Darren Hayman commented on dogging in a song on his fourth album Essex Arms in 2010 . With reference to a contemporary occurrence, the musician Eko Fresh wrote the song U-Bahn-Ficker in 2014 .
