The Federal Association of German Debt Collection Companies e. V. ( BDIU ) is the industry association for the absolute majority of German debt collection companies . The BDIU is a registered association with headquarters and offices in Berlin . The association represents the interests of more than 550 debt collection companies, which in turn represent more than 500,000  creditors . It is the largest association of debt collection companies in Europe and the second largest in the world.

history

The association was founded in 1956 as the Federal Association of German Debt Collection Companies and Credit Information Agencies. V. founded. In 1966 the association was called the Bundesverband Deutscher Inkasso-Unternehmen e. V. (BDIU) and has since focused primarily on debt collection companies. After the European umbrella organization FENCA was founded in 1992, the BDIU became a member there.

Members

Of the 750 or so debt collection companies active on the German market, 560 are  members of the BDIU. The association represents around 90 percent of the total volume of claims. The debt collection companies organized in the BDIU manage to realize five billion euros every year from the claims they have processed .

Study "The debt collection market in Germany"

According to an industry survey (study "Der Inkassomarkt in Deutschland") from 2012, the BDIU debt collection companies focus on the craft (65 percent of BDIU members have craftsmen as customers), the healthcare sector (54 percent), and retail (47 percent) Percent), mail order (46 percent), wholesale / foreign trade (45 percent), banks (28 percent), the energy industry (27 percent), telecommunications (22 percent) and insurers (19 percent). According to the study, collection agencies processed a total of 18.8 million extrajudicial reminders in 2011, of which 15.4 million were processed.

Arbitration Board

The association has set up its own arbitration board (Section 32, Paragraph 1, Letter b of the Articles of Association), which is staffed by an external ombudsman elected by the General Assembly - which is intended to guarantee its independence - who must be qualified to serve as a judge (Section 35 Paragraph 1 Clause 1, Paragraph 2, Paragraph 3 Sentence 2 Statutes).

In the event of disputes among members or organs of the association or between members and organs, they are first obliged to initiate the arbitration procedure before the ordinary courts are called, unless all parties to the dispute agree to forego the arbitration procedure (Section 36 (2) of the Articles of Association).

Application and requirements

For the arbitration procedure, a text or written request (Section 36, Paragraph 1, Clause 1 of the Statutes) with a description of the subject of the dispute (Section 36, Paragraph 3, Clause 1 of the Statutes) is required by one party and - insofar as the management fails to resolve the dispute (Section 36 para. 1 sentence 1 half-sentence 2 of the statutes) - the request of the arbitration board by the presidium or the management is necessary (§ 36 para. 1 sentence 1 half-sentence 1 of the statutes).

Course of the procedure

The arbitration board first determines whether the other party is willing to take part in the arbitration procedure (Section 36 (3), clause 2 of the Articles of Association) and first obtains a statement from this party. As a rule, the arbitration board will submit this statement to the applicant for further discussion.

The arbitration board may in conciliation at any time experts after appropriate consideration, consult (§§ 35 para. 1 clause 2, 36 para. 4 sentence 1 Statute), in matters of data protection experts should Association Commissioner for Data Protection (§ 36 para. 4 sentence 2 Statute).

Attempt to reach an amicable settlement

The arbitration board tries to bring about an amicable agreement between the parties (Section 36 (4) sentence 3 of the articles of association). This is done after obtaining statements from both parties and any expert opinions either via a written proposal or in the context of an oral hearing.

With regard to the procedural costs , as long as the parties do not come to another agreement, the cost cancellation applies (Section 36 (5) sentence 2 of the Articles of Association), whereby the arbitration board determines the object value and the remuneration of the ombudsman and any experts according to ordinary principles in free application (Section 36, para . 5 sentence 1 statutes). The procedure is always free of charge for non-members, with the exception of their own expenses (Section 36 Paragraph 6 Clause 1, 2 Articles of Association). In this case, the member (or body) bears the costs of the arbitration alone (Section 36, Paragraph 6, Clause 3 of the Articles of Association).

German debt collection academy

The Deutsche Inkasso Akademie GmbH (DIA) is a wholly-owned subsidiary of the BDIU. On the one hand, the DIA offers the acquisition of theoretical expertise for registration as a debt collection service provider in accordance with Section 2 Paragraph 1 Clause 1 i. V. m. 4 RDV , as well as various training and further education, primarily in the field of law of obligations , cost law , telephone collection and enforcement law .
