Erich Berneker (legal historian)

Erich Berneker (born April 14, 1905 in Prague , † December 28, 1983 in Würzburg ) was a German legal historian . His specialty was ancient law according to Greek sources.

life and work

Erich Berneker was the son of the Slavist Erich Berneker (1874–1937). He was born in Prague and later grew up in Munich. There he attended the Wilhelmsgymnasium and after graduating from high school (1924) studied law at the University of Munich . He spent the summer semester of 1925 at the University of Heidelberg . After the first state examination in law (February 7, 1928) and a doctorate as Dr. iur. (July 24, 1929) Berneker worked as an assessor for a Munich lawyer and passed the second state examination on November 9, 1931.

From 1931 to 1934 Berneker worked as an assistant to Leopold Wenger . On August 8, 1935 , he completed his habilitation for legal history at the University of Munich. After a substitute chair in Erlangen , he was appointed lecturer in Munich on May 18, 1937. On April 1, 1938, he went to Erlangen University as an associate professor. In 1940 he moved to the University of Prague as a full professor , and in 1941 to the University of Heidelberg.

From 1942 Berneker had to serve as a soldier in World War II . In 1943 he was wounded and released from the front. In 1944 he returned to the University of Prague, where he was taken prisoner of war in May 1945.

After his release, Berneker was appointed professor for civil and Roman law at the newly founded Johannes Gutenberg University in Mainz on May 15, 1946 . In the 1950 summer semester he moved to the University of Würzburg , where he worked until his retirement (September 30, 1973).

Erich Berneker mainly dealt with the Greek litigation. He used inscription and papyrological sources. He has written numerous essays and monographs on judicial and litigation in Ptolemaic Egypt. He also wrote the handbook on Greek legal history (Darmstadt 1968).
