The extra energy GmbH is a German utility company based in Monheim , the nationwide as energy discounter occurs in the market. On the market since 2009, the company claims to be one of the ten largest energy providers in the private customer sector with over one million customers and an annual turnover of 1.021 billion euros (as of 2012). The ExtraEnergie umbrella brand also includes the HitEnergie and Prioenergie brands .

history

In July 2008 ExtraEnergie was founded as an independent energy provider. Sales activities began in the fourth quarter of 2009, starting with electricity products. In mid-2010 the product portfolio was expanded to include the gas division . According to the annual financial statements for the 2011 financial year, 540,000 new customers were acquired in 2011. At the end of July 2012, the company announced that it had acquired over 1 million customers since it was founded. According to its own statements, the company is one of the ten largest energy suppliers out of more than 1100 different providers in the German private customer market. ExtraEnergie has been a member of the Association for Heat Delivery (VfW) since mid-2012 . As a seal bearer, the company undertakes to regularly participate in qualification seminars.

ExtraEnergie GmbH describes itself as a so-called virtual energy supplier, i.e. it buys energy on the market and feeds it into the distribution network companies (VNB).

ExtraEnergie is a wholly owned subsidiary of the investment company Glotec Ventures.

Products and brands

ExtraEnergie focuses on environmental protection and offers exclusively green electricity from 100 percent renewable sources and 100 percent climate-neutral gas. The green electricity certified by TÜV Nord guarantees an electricity mix , the generation of which is used to offset the CO 2 emissions by investing in climate protection projects. The pollutants that arise during the combustion, extraction, transport and processing of natural gas are offset by investments in climate protection projects.

The three brands extraenergie , prioenergie and HitEnergie are brought together under the umbrella brand ExtraEnergie . A further product differentiation is made into extrastrom and extragas , priostrom and priogas, and HitStrom and HitGas .

Rates

The company sells different tariffs, both to private customers and business customers. All tariffs have in common that there is no prepayment. In addition, all tariffs include a price fixation (price guarantee). The consumer can choose between tariffs with a contract term of 12 and 24 months and tariffs with or without a new customer bonus. In addition to tariffs that are independent of consumption, the company also offers package tariffs, whereby a minimum consumption quantity is prescribed. The energy supply is paid for in monthly installments.

ExtraEnergie pursues a multi- brand strategy through various sales channels. This includes sales via the company's own website and cooperation with various sales partners. This includes, for example, direct sales or various price comparison portals on the Internet, such as Check24 or Verivox . Even if a wide range of sales channels is used, the online market is dominant with over 50% of deals.

Electricity labeling

According to Section 42 of the Energy Industry Act (EnWG) on electricity labeling , all energy supply companies in Germany are obliged to publish information on the mix of energy sources and environmental impacts. ExtraEnergie published the following values ​​for 2010:

criticism

Especially at the beginning of 2012, ExtraEnergie had to face several allegations on the part of customers and the press. Most of these allegations were directed against the late and incorrect preparation of the annual accounts. The company responded in writing several times, stating that the problem was due to strong customer growth at the beginning of 2011 and the poor quality of information from regulated meter reading companies on which the company depends. This has led to a reduced service quality in the company. According to the company, this problem has now been taken into account through the development of service capacities and an extensive quality program. According to a study from 2018, ExtraEnergie is the electricity provider with the third most common consumer complaints.

Some customers also complained that the discounts were not adjusted downwards accordingly after lower consumption. The consumer center NRW in this context class action before the District Court of Dusseldorf filed against extra energy. The Neuss-based company commented on an article in Die Welt and explained that ExtraEnergie, in contrast to a basic supply company, is more of a virtual energy trader . Since such virtual energy traders do not have “the connection privilege of the basic supplier”, the statutory regulations for the basic supplier would also apply “merely as a guiding principle”, but of course be implemented where possible.

It was reported to the WDR that consumer prices had increased despite a price guarantee that was subject to a fee. The company also stated price increases in e-mails “hidden at the end”.

On December 9, 2015, the Düsseldorf Regional Court declared the price increases sent by ExtraEnergie GmbH to be invalid. The consumer center Saxony had sued against the practice that ExtraEnergie announced price increases in seemingly insignificant e-mails.

On August 3, 2016, the Düsseldorf Regional Court (12 O 91/15) found the cease and desist declaration submitted by the North Rhine-Westphalia consumer center with regard to the non-transparent drafting of contracts in 11 clauses of the general terms and conditions to be permissible and justified. The clauses largely violate §§ 307 ff. BGB, 41 EnWG. On April 19, 2018, ExtraEnergie GmbH appealed to the Düsseldorf Higher Regional Court (I-6 U 182/16). The Higher Regional Court of Düsseldorf has prohibited Extra Energie GmbH from using a total of 12 general terms and conditions in energy supply contracts. Among other things, three clauses on package tariffs and five price adjustment clauses that exclude customers' special right of termination are ineffective. Extra Energie GmbH lodged a complaint against this with the BGH. The appeal of Extra Energie GmbH against the non-admission of the revision was rejected by the BGH. The judgment is final (file number VII ZR 119/18).

Customers with package tariffs

After the BGH rejected the non-admission complaint of the company ExtraEnergie GmbH (file number VII ZR 119/18) by decision of November 26, 2019, all clauses of Extra Energie GmbH on price adjustments and some clauses on the package tariff are ineffective. In this regard, the North Rhine-Westphalia consumer center provides three sample letters on its homepage with which customers at ExtraEnergie GmbH can request a partial refund of money paid for package tariffs, reclaiming of electricity price increases for package prices and the reclaiming of electricity price increases - retrospectively until 2017.
