François Denis Tronchet

François Denis Tronchet (born March 23, 1726 in Paris ; † March 10, 1806 there ) was a French lawyer .

Life

Tronchet had been a lawyer since 1745 and was admitted to the Parliament of Paris , where his father was a public prosecutor (Procureur). On May 13, 1789 he was elected as a deputy to the Estates General (États Généraux). In vain he opposed the transfer of the Estates General to the Constituent Assembly (Assemblée nationale constituante), where he was particularly noticeable for his opposition to the introduction of jury courts in civil trials. In the French Revolution , from December 1792 to January 1793, he defended King Louis XVI courageously and skillfully with Raymond de Sèze and Chrétien-Guillaume de Lamoignon de Malesherbes , but ultimately in vain . before the National Convention . During the board of directors he was a member of the "Council of the Elderly" (Conseil des Anciens) from 1800 to 1804, where he tried in vain to prevent judges from being appointed by the executive branch. Under the consulate he was also President of the Court of Cassation ("Tribunal de Cassation") and was involved in the drafting of the " Code civil " - the first civil code - in a commission initiated by Napoleon and led by Jean-Jacques Régis de Cambacérès . He advocated a judiciary based on precedents, in contrast to some of his colleagues who were under Roman law . He was also instrumental in drafting the sections relating to inheritance law and mortgage law. In 1801 he became senator of the Somme department.

After his death he was buried (as the first senator of the "Empire") on March 17, 1806 in the Pantheon .
