Franz Wurst (born March 20, 1920 in Vienna ; † April 9, 2008 ) was an Austrian pediatrician . In 2002 he was tried and convicted of inciting the murder of his wife and the sexual assault of numerous underage patients.

Medical career

Wurst studied medicine with Hans Asperger and acquired his Dr. med. univ. at the University of Vienna . Even later he was proud to have been "the youngest doctor of the Third Reich ". Then he allowed himself to healing educationally oriented specialist for pediatrics and children neuropsychiatrie train. He practiced as a pediatrician and curative teacher . In 1948 he became director of the 1st Institute for Educational Aid in Vienna, and in 1951 he took over the management of the youth welfare and curative education service of the federal state of Carinthia in Klagenfurt .

In 1964 Wurst completed his habilitation at the University of Vienna in the field of paediatrics. In 1968 he became Primarius of the curative education department of the Klagenfurt Regional Hospital . Wurst was the author of several medical books. In 1971 he was appointed associate professor at the University of Vienna . He was also a visiting professor at the University of Klagenfurt and worked as a court expert .

Wurst, which was considered a "courted capacity", bore the title of Hofrat . In 1981 he received the Golden Medal of the City of Klagenfurt, which was revoked on November 18, 2003 by decision of the Klagenfurt City Senate and had to be returned to the city. In 1987 he received the Great Gold Medal of Honor of the State of Carinthia , and in 1998 the Paracelsusring . He was buried at the Döblinger Friedhof .

Criminal proceedings

For almost two decades, children reported sexual abuse through sausage to the staff of the curative education department , but they were not believed. A victim's lawsuit in 1982 against the sausage, which was considered “socially inviolable”, was “covered up” by the authorities. Only after some of his former patients had reported attacks to the Klagenfurt psychology professor Jutta Menschik-Bendele , in 2000, she made the ethics committee of the Carinthian State Association for Psychotherapy aware of the cases. Sausage justified his behavior as attention therapy to overcome fear of contact.

On December 8, 2000, Wurst's wife was found dead. In the course of the investigation, remand against Wurst was ordered on December 19 . In 2002 he was charged with inciting his godson Thomas H., whom he had sexually abused for years, to murder his wife because she stood in the way of this relationship. The reported occupational sexual assaults by sausage were also charged during the trial. In their plea , the public prosecutor's office accused Wurst of having acted out his pederastic inclinations during his medical work and of exploiting the helplessness of his victims to satisfy his own instincts. 38 former underage protected patients Wursts testified in court. They said they had been abused by him in several reform and convalescent homes.

Wurst was found guilty on both counts and sentenced on December 20, 2002 to 17 years in prison. The Paracelsus ring was withdrawn from him. The federal state of Carinthia and the responsible hospital operating company paid compensation totaling 540,000 euros to 48 victims of abuse.

After serving four years, Wurst was released due to incapacity to custody, which caused a great public stir. The then Carinthian Governor Jörg Haider described the early release as a “judicial scandal and an affront to the many victims of abuse”. Wurst spent the last year of his life in a nursing home in Vienna.

An opera about the Wurst case with a libretto by Nobel Prize winner Elfriede Jelinek was planned for the 2006 Salzburg Festival . The project was not implemented.
