Heinz-Joachim Neubürger

Heinz-Joachim Neubürger (born January 11, 1953 in Marl ; † February 5, 2015 in Munich ) was a German manager. From 1998 to 2006 he was CFO of Siemens AG .

Life

After graduating from high school, Neubürger trained as an export merchant , followed by a Master of Business Administration at the French University of Insead . From 1979 to 1989, Neubürger worked for the investment bank JP Morgan in the areas of export and project finance and corporate finance, including in Tokyo . In 1989, he first moved to Siemens as Head of Investor Relations , then headed global treasury before taking on the position of CFO for Siemens India. In 1998 he was appointed to the Siemens central board as head of the central finance department. He was responsible for the IPO of Infineon , the internationalization of accounting and the listing of Siemens AG on the New York Stock Exchange . At the beginning of 2006, Neubürger, who had at times been traded as a possible successor to Heinrich von Pierer as CEO , left Siemens. His successor as CFO was Joe Kaeser .

In November 2006, Siemens became aware of illegal business practices in foreign legal transactions, which developed into one of the biggest corruption scandals in German economic history, as a result of which CEO Klaus Kleinfeld and Supervisory Board chairman Heinrich von Pierer left the company in 2007.

In 2008, the company filed claims for damages against eleven members of the Board of Management for violating organizational and supervisory duties. With nine former board members one was in December 2009 compared concluded with another member in December 2012. Since it with new citizens in advance of the general meeting did not come to a settlement, January 2010, Siemens brought in January 2010 before the Munich District Court action for payment of Compensation of 15 million euros. Criminal investigations against new residents were discontinued in 2011 by the Munich public prosecutor after paying a donation of 400,000 euros to charitable organizations. In autumn 2013, the court suggested that the parties conclude a settlement for an amount of 900,000 euros. This proposal was not accepted by Siemens. As a result, in December 2013 the regional court upheld the lawsuit against new residents due to the overall legal responsibility of each board member. Legal literature rated the judgment as a precedent and “landmark decision”.

In 2014, Siemens and new residents reached a settlement for a payment of 2.5 million euros. In the reason for the settlement proposal to the shareholders , the Supervisory Board praised "Mr. Neubürger's undisputed services to Siemens AG". The Annual General Meeting approved the settlement on January 27, 2015.

Neubürger worked for Kohlberg Kravis Roberts & Co. from 2007 to 2009 , and for a short time he was chairman of the supervisory board at Koenig & Bauer . Until the time of his death, Neubürger was a member of the Supervisory Board, the Strategy and Finance and Audit Committees of Deutsche Börse and a member of the Board of Trustees of the Allensbach Demoskopie Foundation .

Before that, Neubürger was a member of the supervisory boards of BMW AG , ProSiebenSat 1 Media AG , Allianz Lebensversicherungs-AG and Infineon Technologies AG . His international mandates included Merrill Lynch & Co , New York, and Gruppo Banca Leonardo SpA, Milan.

From 2005 to 2010, Neubürger was chairman of the German Accounting Standards Committee (DRSC). He was a founding member of the Berlin Center of Corporate Governance (BCCG).

New residents committed suicide on February 5, 2015 .
