Homosexuality in Algeria

In Algeria, homosexuality is a criminal offense and is socially taboo.

Homosexual acts in Algeria can be punished with imprisonment for up to three years and a fine of up to 10,000 dinars (about 85 euros).

It is believed that the law was founded on the idea that homosexuality is incompatible with the Islamic faith (cf. Zina and homosexuality in Islam ). The laws here are related to other laws, such as the prohibition to change one's religion.

According to the 1966 Criminal Code in Algeria:

“Anyone guilty of a homosexual act is punished with imprisonment between two months and two years and a fine between 500 and 2,000 dinars. If one of the parties involved is under eighteen years of age, the sentence of the older person can be increased to up to three years imprisonment and a fine of 10,000 dinars. "(Art. 338)
“Anyone who has caused public nuisance is punished with imprisonment between two months and two years and a fine between 500 and 2,000 dinars. If the excitement of public nuisance consisted of an unnatural act with a person of the same sex, the imprisonment is between six months and three years and the fine between 1,000 and 10,000 dinars. "(Art. 333)

Incidents

In 1994 and 1996 one homosexual man was murdered by the Groupe Islamique Armé . In 2001, two homosexuals were publicly stoned . In 2004, the Algerian Ramzi Islam, who was persecuted in his home country because of his homosexuality, was granted asylum in the United Kingdom . The first known attempt at a same-sex wedding ceremony ended on May 16, 2005 in a hotel with a police operation. On February 10, 2019, a homosexual medical student had his throat cut in his room on the Ben Aknoun campus of the University of Algiers. The murderers wrote " He's gay " on the wall with the blood of the killed student .

Anti-discrimination laws

Due to the illegality, there are no anti-discrimination laws nationwide .

Recognition of same-sex couples

As a result of their illegality, homosexual couples are not recognized by the state as same-sex marriages or as registered partnerships .
