In Libya, homosexuality is largely taboo and homosexual acts are punishable.

If same-sex people have sexual intercourse, they are punished for sexual intercourse outside of marriage for up to five years in accordance with Article 407, Paragraph 4 of the Criminal Code. Under Article 408 (4), common voluntary lewd acts are also punishable by five years. According to the UK Foreign Office, the minimum sentence is 3 years.

Social situation

There is no homosexual community in Libya. There is hardly any news from this country related to the topic. Some homosexual people are trying to get to Europe to find a better life there. For example, a girl who was arrested, raped and then brought to her family, who tried to force her to marry off after she wrote on the Internet that she was a lesbian.

Third chapter: offenses against freedom, honor and morality
Art. 407 (rape / rape)
(1) Anyone who has sexual intercourse with another person using violence, threats or deception shall be punished with a prison sentence of no more than 10 years.
(2) The penalty also applies to a person who has sexual intercourse with the consent of a person who is not yet 14 years old or with a person who has not resisted due to mental or physical disability. If the victim was not yet 14 years old, or had reached the age of 14 but not yet reached the age of 18, the maximum prison sentence is 15 years.
(3) If the perpetrator is a relative of the victim, a legal guardian, a supervisor or an authorized representative, or if the victim is his servant or if the victim is particularly dependent on the perpetrator, a prison sentence of between 5 and 15 years is imposed.
(4) If someone has sexual intercourse with a person with their consent (outside of marriage), both persons involved will be punished with a prison sentence of a maximum of 5 years.
Art. 408 (fornication)
(1) Anyone who commits fornication on a person in accordance with one of the methods mentioned in the previous article shall be punished with a prison sentence not exceeding 5 years.
(2) The penalty also applies if the act was committed with the consent of a person who has not reached the age of 14 or with a person who has not resisted due to mental or physical disability. If the victim was between 14 and 18 years of age, the prison sentence is at least one year.
(3) If the perpetrator belongs to one of the perpetrators group named in Article 407, Paragraphs 2 and 3, a prison sentence of at least 7 years shall be imposed.
(4) If someone commits fornication with a person with their consent (outside of marriage), both persons involved are punished with imprisonment.
