Joachim Blüting , also Plüting , (* 1572 in Kiel ; † after 1643 , possibly 1644 ) was a German court court advocate and commentator on the Jütschen Lowbuch .

Live and act

Joachim Blüting was the son of a father of the same name (1526-1606) and his wife Catharine, née Marquards. The father worked as archdeacon (2nd pastor) at the Nikolaikirche in Kiel .

From 1594 he studied at the University of Rostock and at the University of Helmstedt . Blüting worked as a court attorney in Schleswig-Gottorf . According to the protocol of the appointment of March 25, 1606, he was supposed to deal with legal affairs of the Gottorfischen office as a lawyer and “servant from home”. His annual salary was 30 Reichsthaler. As a public prosecutor, he should provide support in all “controversial and erroneous matters” by means of “speeches, advice and writing”. It is known that in 1610 he conducted an interrogation in a hearing against Wolf Kalundt and his wife Margaretha, née von Eitzen, who allegedly murdered their son-in-law, the Aabenraa mayor Claus Esmarch.

Blüting was married to Anna Hardisch, the daughter of the notary Hartwig Hardisch and Anna Ridisch.

Works

Blüting published extensively on legal topics. He probably completed his main work, a gloss on the Jütsche Lowbuch , in 1643. The work, which Eugen Wohlhaupter called the “famous gloss”, was first published in 1717 in Flensburg. His manuscript is preserved in the Kiel University Library . Blüting used Blasius Eckenberger's translations from 1590 and 1593. He checked his translation extremely critically and corrected it wherever possible. The courts of the Duchy of Schleswig had to purchase Bluing's book based on a rescript dated February 5, 1722. You should only follow his texts "in iudicano" where they would be "conform" to the Low book .

Blüting dealt with the Lowbuch in two other notable works . The inheritance law according to the Jütschen Land law or Low book, brought into good order and declared to the common man in the Duke of Schleswig , he probably also concluded in 1643. The Observationes iuris Cimbrici and Von somecherley manslaughter in the Jütschen Low appeared in 1835 as articles in print by Niels Nikolaus Falck . Falck judged that Blüting was the main commentator of the Jütschen Lowbuch . To a certain extent, he was "a legally recognized authority". Due to the "practical usability" one should carefully observe the interpretations, so the legal scholar.
