Kurt Lipstein QC (born March 19, 1909 in Frankfurt am Main , † December 2, 2006 in Cambridge , UK ) was a lawyer from Germany and a professor at Cambridge University .

Life

After graduating from the Goethe-Gymnasium in Frankfurt, Kurt Lipstein studied law from 1927, initially at the University of Grenoble (today: University of Joseph Fourier) and from 1927 to 1931 at the Friedrich Wilhelm University of Berlin (today: Humboldt University of Berlin) with Wolff and Rabel as well as by Caemmerer and Mezger. His classical school education in Greek and Latin later enabled him to gain a deeper insight into Roman law . After completing his studies, he completed a legal clerkship in Königstein im Taunus and at the regional court in Frankfurt am Main .

When the National Socialists came to power in 1933, he lost his job as a Jewish assessor. In 1934 he emigrated to England . At Trinity College , Cambridge in 1936 he was with the work: "Roman Law the beneficium cedendarum actionum" doctorate . For financial reasons Lipstein could not be offered a scientific teaching position. Harold Gutteridge, professor of comparative law at Cambridge University, hired him as a lecturer and paid him out of pocket.

With the outbreak of World War II , he was interned in a British refugee camp in Bury St. Edmunds and later Liverpool in 1940. In the camps he met numerous other non-British scholars, such as the grandson of the German Kaiser Wilhelm II. In the camp itself, scientifically based lectures were held. At the request of Cambridge University, he was released and taught at the law school. In 1956 he became an official member of Clare College (so-called fellow). In 1973 he was appointed professor for comparative law . In 1977 he was awarded an LL.D ("Legum Doctor") on his retirement .

Lipstein was the last living lawyer who had to emigrate to England after the Nazis came to power in Germany, where he had to build a new life in research and teaching.

Kurt Lipstein was one of the most renowned experts in international private law and left an important mark there in the supranational area and especially in English conflict of laws. He was also co-editor of the monumental work Encyclopaedia of Comparative Law . German jurisprudence owes a lot to him, especially for his work after 1945.
