David Bardens

David Bardens (born April 27, 1984 in Homburg ) is a German doctor . He gained notoriety in the spring of 2015 after the Ravensburg Regional Court awarded him the prize of 100,000 euros in the first instance in the legal dispute against the biologist Stefan Lanka , which Lanka had given for the detection of the measles virus . In the second instance, David Bardens lost before the higher regional court in Stuttgart.

Life

After his community service , Bardens completed training as a paramedic at the Arbeiter-Samariter-Bund in Mainz . He completed his studies in human medicine in Homburg in 2014 with a dissertation on laparoscopic hysterectomy : new insights into surgical techniques, influencing factors and the postoperative course of pain . During his studies he worked, among other things, as a teacher at a midwifery school and as a perfusionist at the German Organ Transplantation Foundation . In 2011 Bardens founded a food company in Bremen that sells the anti-hangover lemonade freigeist . After completing his doctorate, he worked briefly as an assistant doctor at the University Women's Clinic in Homburg, but then moved to Sweden, where he currently practices as a general practitioner. He is a grandson of the former member of the Bundestag Hans Bardens (SPD). He has been a member of the scientific advisory board of the Hans Albert Institute since 2020.

Trial against Stefan Lanka

In November 2011, vaccination opponent Stefan Lanka, known from publications, offered online prize money of 100,000 euros for the proof of existence of the measles virus and the determination of its diameter. Lanka takes the scientifically unrecognized view that measles originates from a combination of psychosomatic reasons and poisoning. Bardens, at the time still a medical student, had the seriousness of the advertisement from Lanka confirmed in writing on January 30, 2012 and, upon confirmation, put together six articles from specialist journals that provide the required evidence and which he sent to Lanka by registered mail, stating his account number with the request to transfer the prize money to him. Lanka refused, whereupon Bardens brought an action at the Ravensburg Regional Court.

Numerous media, including international ones, reported on the measles trial . Lanka took the position that the pictures in the articles did not show the measles virus but other viruses. In addition, he expressly requested publications from the Robert Koch Institute in the invitation to tender and therefore continues to refuse to pay out the prize money.

Judgment of the Ravensburg Regional Court of March 12, 2015

The Ravensburg Regional Court requested an expert opinion from the director of the Institute for Medical Microbiology, Virology and Hygiene in Rostock, Andreas Podbielski . The question to be clarified is whether the publications used meet scientific standards and, according to the current state of science, provide the evidence at issue. As a virologist, Lanka had used the same techniques in his dissertation as the authors of the submitted work. The regional court awarded Bardens the full amount of the prize money on March 12, 2015. Lanka announced that it would appeal the verdict . Since the trial, Bardens says he has only been able to appear publicly with bodyguards in Germany, as he was personally threatened by opponents of vaccinations.

Judgment of the Stuttgart Higher Regional Court of February 16, 2016

The Stuttgart Higher Regional Court granted the appeal on February 16, 2016. This was justified with the special nature of the award : The sponsor (Stefan Lanka) wanted a single piece of work with the evidence, but the plaintiff had provided several publications that could only provide evidence in total.

After the ruling by the Stuttgart Higher Regional Court, Bardens lodged a non-admission complaint with the Federal Court of Justice (BGH). This was rejected by the BGH on January 20, 2017. The decision of the OLG is now final.
