Mathias Habersack (* 1960 ) is a German lawyer and professor at the Ludwig Maximilians University in Munich .

Life

Habersack studied law in Würzburg and Heidelberg . In 1986 he became a research assistant for Peter Ulmer . With a thesis on "Freedom of Contract and Third-Party Interests" he was awarded a Dr. iur. PhD. From 1991 Habersack was Ulmer's research assistant. During his assistantship he worked on his paper on corporate membership , which led to his habilitation in 1995.

On April 1, 1996, Habersack accepted a position at the University of Regensburg . From 2000 to 2007 he held the chair for civil law, commercial and corporate law, and business law at the University of Mainz and, since 2003, has also been director of the Institute for German and International Law of Savings, Giro and Credit Systems. In the 2007/08 winter semester, Habersack moved to the University of Tübingen as the successor to emeritus Harm Peter Westermann . Since April 1, 2011 he has held the chair for civil law and corporate law at the University of Munich - after an offer to the University of Bonn was rejected (Chair for Civil Law, Commercial and Corporate Law) .

Habersack is the chairman of the permanent deputation and thus president of the German Lawyers' Association , a member of the Legal Science Expert Committee of the German Research Foundation, the Working Group on Economics and Law in the Stifterverband für die Deutschen Wissenschaft , the Takeover Advisory Board (Section 5 of the Securities Acquisition and Takeover Act ), the board of the Association for Company Law and the Board of Directors of the Banking Law Association.

In 2020, Habersack was ranked among the most important German corporate law lawyers in a ranking by Handelsblatt .

Habersack's students are Dirk A. Verse and Jan Schürnbrand .

Varia

According to a report by the LTO , Habersack is said to have been one of the experts in the proceedings for the granting of the honorary professorship for the incumbent President of the Federal Constitutional Court, Stephan Harbarth . The award of the honorary professorship to Harbarth has been criticized, among other things because of the proximity of his former law firm Schilling, Zutt & Anschütz (SZA) and that of the experts involved. Harbarth received his doctorate there during Habersack's time at Peter Ulmer's chair. Today Ulmer is Of Counsel at SZA. The second expert, Walter Bayer , is also very close.
