Music pirates e. V. is a German association whose aim, according to its own statement, is the "promotion of free culture with a focus on music as a means of artistic expression". It was founded in June 2009 by musicians and members of the Pirate Party Germany .

Club activity

Musikpiraten organized the Free! Music! Contest . The concept of the competition is based on that of the Open Music Contest : Only bands and musicians who publish their works under a Creative Commons license can take part. According to the organizers, over 130 artists from around 30 countries took part in 2010. The association achieved this great international fame of the competition by winning the author Cory Doctorow as patron. Bands on the Free! Music! All: my: faults , Pornophonique , David Rovics and Raziel Jamaerah have participated or played in the contest .

In March 2010 the association organized a networking project for music bloggers under the motto "# 37cc - a week of free music". 70 participants recommended music licensed under Creative Commons via Twitter , identi.ca and their blogs. In December 2010 the association published a songbook with Christmas carols in the public domain.

After GEMA in a nationwide letter to day-care centers in 2010 demanded a fee of 56 euros for 500 copies for copying sheet music, the association decided to publish a song book with public domain children's songs and to distribute this free of charge to all day-care centers in Germany. Within a few weeks, more than 40,000 euros were donated to the music pirates, so that 54,800 song books could be produced and distributed. In September an instrumental version of all the songs was released for download, which could also be ordered free of charge on CD from the association.

After the production and publication of a compilation of the winning titles of the Free! Music! Contest 2011 under a CC license, GEMA sued the Musikpiraten e. V. and demanded the disclosure of the real names of two members of the band "texasradiofish", who published their music with the music pirates under pseudonyms. GEMA therefore refused to confirm that the title in question is GEMA-free, as it cannot be ruled out that the musicians are under contract with a collecting society and that the title would therefore be subject to GEMA ( GEMA presumption ). In the opinion of the music pirate, however, a license claim should be excluded due to the possibility of pseudonymous and anonymous publication, which is anchored in German copyright law. On August 27, 2012, the Frankfurt am Main district court ruled in favor of GEMA and obliged Musikpiraten e. V. to pay the amount in dispute of 68 euros plus interest, but allowed an appeal to the regional court due to the fundamental importance of the lawsuit. This was dismissed on September 5, 2013 by the Frankfurt Regional Court. Further legal remedies were not permitted due to the low amount in dispute.

On December 1, 2013, the Musikpiraten published the third edition of the collection of songs in the public domain, "Singen im Advent". Like its predecessors, the book can be downloaded as a PDF file or ordered in printed form.
