Legal adjustment

The legal adjustment is a concept of the legislative theory . It describes the processing of legal matter by eliminating all those legal provisions that have become obsolete through later laws and combining all currently applicable provisions into a single legal compendium . A subject is thus published in a new order in a single collection in order to make researching what applicable provisions are and what are not superfluous, without creating new law.

A distinction must be made between global and individual case-based settlement: In the event of a dispute or doubt, individual case-based settlement clarifies whether a regulation already or still applies. She is preparing a legal decision. The global adjustment, on the other hand, takes place without a specific reason and is preparing a publication.

The task of correcting the law is therefore

  1. collecting all theoretically relevant standard material and
  2. the elimination of all parts that have become invalid according to legal rules (> conflict of laws ).
  3. The subsequent publication takes place partly only in list form, partly also as a complete collection of rules.

Because it is not the individual change instructions chosen by the constitutionally responsible normative body that are published from the official announcement bodies, but newly compiled reading texts, we also speak of art texts . In Germany , the form of the ministerial "announcement of the new version" is often chosen for frequently amended laws. The federal government in the 16th legislative period had a legal rectification project. In the 17th legislative period z. B. the law on the further adjustment of transitional rights from the Unification Agreement of January 21, 2013 ( Federal Law Gazette I p. 91 ). In the 18th legislative period, the law on the further adjustment of federal law of July 8, 2016 ( Federal Law Gazette I p. 1594 ) was passed.

Legal basis

The task of rectifying the law is rooted in the constitutional principle of the rule of law , because the state has to make the norms that it demands compliance with accessible. In practice, the state publication of standards required by this is mostly accompanied by the private and commercial creation of reading texts, and sometimes even replaced.
