The Special Leave Ordinance (SUrlV) regulates special leave for federal civil servants in Germany . For judges in the federal service , this regulation applies accordingly in accordance with Section 46 of the German Judges Act . For Soldiers In accordance with § 9 soldiers holiday Regulation (SUV) Regulation accordingly if the SUV provides otherwise. The vacation leave for federal civil servants, federal judges and soldiers (in accordance with the SUV) is regulated in the vacation leave ordinance.

General

The decision on granting special leave is generally made by the personnel administration service authority. ( § 2 SUrlV) According to § 3 SUrlV, it is only granted if, firstly, the occasion for which special leave was requested cannot be taken or taken care of outside of working hours , secondly, there are no business reasons conflicting with it and, thirdly, the respective requirements of §§ 5 bis 22 SUrlV are fulfilled. The duration of the special leave also includes the necessary travel times. ( § 4 SUrlV)

Special leave is to be applied for immediately after the occasion becomes known , in cases of § 21 SUrlV promptly. ( Section 23 SUrlV) The approval of special leave must be revoked if this is required for compelling business reasons, if the special leave is used for a purpose other than the authorized one or if other reasons for which the applicant is responsible require revocation. ( § 24 SUrlV) If the approval of special leave is revoked for compelling business reasons, the applicant will be reimbursed for the additional expenses incurred as a result of the revocation in accordance with the provisions of travel expense law . ( Section 25 Paragraph 1 No. 1 SUrlV)

In agencies with flexible working hours and core time , special leave is usually only granted for the time of the necessary absence that falls within the core time. If no core time has been agreed in the department, special leave that only requires an hourly absence may not be granted at all. From the basic duty of the civil servant to dedicate himself to his profession with full dedication ( § 61 Abs. 1 S. 1 BBG ) it follows that he z. B. must seek appointments for visits to the doctor that are outside the core hours.

Individual events

Special leave is to be granted with continued payment of salary :

  • for exercising civic rights and fulfilling civic obligations ( § 5 SUrlV)
  • in the context of the rise in a raceway of the upper or higher service with the consent of BMI ( § 8 SUrlV)
  • for training or further training each up to five working days ( § 9 SUrlV)
  • for foreign language training or further training in a country in which the language to be learned is spoken, provided that the training or further training is in the interests of the service, up to three months ( § 10 SUrlV)
  • for military and civil defense purposes ( § 11 SUrlV)
  • for political purposes ( § 12 SUrlV)
  • for training as a nurse's aide or Nursing helper , for the duration of a training course closed, but for a maximum of 20 working days in the calendar year ( § 14 SUrlV)
  • for trade union purposes up to five working days per calendar year ( § 15 SUrlV)
  • for church purposes up to five working days per calendar year ( § 16 SUrlV): This includes participation in church days and World Youth Day as well as similar church events (Bible weeks) and trips (pilgrimages) with a corresponding framework. This does not include the organization of a corresponding event.
  • for sporting purposes up to five working days per calendar year ( § 17 SUrlV)
  • one working day for family trips home in a calendar year within a period of two months ( § 18 SUrlV)
  • for business reasons such as change of residence and anniversary of service one to three working days ( § 19 SUrlV)
  • for medical reasons for the duration of the necessary absence ( § 20 SUrlV)
  • for personal reasons such as the birth of the wife, death of the spouse, child or parent ( § 21 SUrlV)

To pay, which is paid for that include as remuneration , the basic salary (table value of grade and possibly experience level ), the family allowance , bonuses , allowances and abroad and grade candidates references and RRSPs . ( Section 26 Paragraph 1 in conjunction with Section 1 Paragraph 2 f. BBesG )

Special leave is to be granted with no salary:

  • to exercise an activity in public intergovernmental or supranational institutions or in a public institution of a member state of the European Union ( § 6 SUrlV)
  • to carry out development cooperation tasks for up to five years ( § 7 SUrlV)
  • to perform voluntary services ( § 13 SUrlV)

Special leave can be granted without the salary:

  • if there is an important reason ( § 22 SUrlV)
