Higher service

The senior service (gD) is a career group in German civil service law - subdivided into the senior technical service (e.g. fire brigade) and the superior non-technical service (e.g. administrative service), as well as careers with a specialty .

From 1927 to 1939 the corresponding career was called upper middle service . After a career group reform, the senior service was redrafted in some federal states as the 1st entry office in the 2nd career group or qualification level 3 (3rd QE).

The former Federal Border Guard (now: Federal Police ) held military ranks with the addition “in the Federal Border Guard” (“in the BGS”) until June 30, 1976 . During the reform of personnel law, the officers in the ranks "Leutnant im BGS" / "Leutnant zur See im BGS" to "Hauptmann im BGS" / "Kapitänleutnant im BGS" were assigned to the higher service , the other officers to the higher service .

The tasks of the higher service of officials extend, depending on the career and the authority of the officer level to the leadership of subject areas , worked as office manager , department heads , permanent representative of department heads , speakers and deputy heads of units in federal , countries and communities as well as other Corporations , institutions and foundations under public law , insofar as they are employers .


The basic school requirement for admission to the preparatory service with studies is at least the technical college entrance qualification . Most applicants, however, have general or subject-specific higher education entrance qualifications . The participation of suitable applicants from the middle service is also possible without a university entrance qualification. For careers without a degree but with preparatory service (e.g. in the fire service or construction service), a completed university of applied sciences degree is required (usually with the academic degree of a graduate engineer (FH) or a bachelor's degree). For careers with low staffing requirements ( careers with a special subject ), special requirements apply, but a degree from a technical college and usually several years (usually three to five years) professional experience are required.

The training for the higher non-technical administrative service and similar subjects in the administration of justice and with the police takes place in the context of a study at a special college for public administration . The course usually concludes with an academic degree , for example " Diplom-Verwaltungswirt (FH) " in various fields, " Diplom-Finanzwirt (FH) " in various fields, "Diplom- Rechtspfleger (FH)" in Baden-Württemberg also "Württembergischer Notariatsassessor" (at the Notarakademie Baden-Württemberg ). Graduates of these courses from the middle service without a university entrance qualification, so-called promotion officials, complete their training with the career test alone (see also: Framework Act for Higher Education ).

It is also possible to study administrative business administration as well as a degree in business administration (FH) or a degree in business administration (FH) specializing in administrative management with a standard study period of eight semesters at a university of applied sciences .

School service is an exception. Here, the general higher education entrance qualification (Abitur) is usually a prerequisite for studying, which is completed at a university in most federal states. Depending on the federal state, the course is followed by a 12- to 24-month preparatory service ( legal clerkship ).

The courses of study will be converted to Bachelor and Master degrees in accordance with the Bologna Treaties . The first degree becomes a "Bachelor of Arts (BA)", "Bachelor of Science (B.Sc.)" (University of the Deutsche Bundesbank) or "Bachelor of Laws (LL.B.)" (University of Economics and Law Berlin; Fernuniversität Hagen ). The examination regulations for the LL.B at the Fernuniversität Hagen have been in place since October 31, 2003. The Master of Public Administration - MPA - will also be possible online from the summer semester 2008 at the HWR Berlin (as already at the University of Kassel ).

At the Nordhausen University of Applied Sciences , a bachelor's degree with career qualification for the higher non-technical service (public business administration, seven semesters) was also introduced in the winter semester since 2003 and a master’s degree with later access to higher service (public management & governance, three Semester). In Baden-Württemberg, the first bachelor's degree started in the summer semester of 2008 at the two universities for public administration in Ludwigsburg and Kehl .

After all this, the development is not uniform, which is due, on the one hand, to the cultural sovereignty of the 16 federal states and, on the other hand, to the almost complete referral back of the civil service powers as a result of the federalism reform to the states for their area. In this respect, the federal government will have to bring about their agreement depending on the location of its universities of applied sciences.

Classification in grades

The starting salary group for careers with studies in preparatory service is salary group A 9 in the non-technical service and A 10 in the technical service, for careers without studies in preparatory service the salary group A 9 (except in the fire service in some federal states).

For district notaries in Württemberg and for primary and secondary school teachers, the starting salary group is A 12, for Real and special school teachers it is usually A 13.

Public lawyers , whose starting salary group is A 12, are also an exception .

Differentiation from other public service relationships

Officers of the Bundeswehr in the ranks of lieutenant to staff captain or corresponding naval ranks (A 9 to A 13 BBesO, the latter rank only for officers of the military service ) have the same salary as the civil servants of the higher service. However, you are doing military service. They are therefore not comparable, neither in terms of their legal status, nor of the (educational) prerequisites, nor of typical business activities.

Temporary soldiers of any rank who are entitled to an integration or approval certificate and thus want to switch to the (civil) public service at the end of their period of service are entitled to the provision of vacancies ( StVorV ) in conjunction with Section 10 (4) Soldiers Act (SG) also assigned to the desired employer as civil servants on revocation in the preparatory service or civil servants on probation and assigned to the reserved position . According to Section 46 (3a) of the Soldiers Act, professional soldiers are dismissed by law if they are appointed civil servants. A discharge order ( administrative act ) is not required.

Women carry the official designation in the female form, if linguistically possible with the ending "-in", the exceptions are the designations Amtmann / Amtfrau . For a while the term government official was used in some federal states instead of a government official. In the Federal Customs Administration , too, the designation "Zollamtmännin" (alternative to "Zollamtfrau") could be chosen until 2011.

The official name is depending on the service master function and a part added (z. B. Administration Oberamtsrat or Regierungsbauoberamtsrat).

Job title during the preparatory service: Candidate, either with an addition that corresponds to the entrance office that is reached after the preparatory service (e.g. police commissioner candidate, government inspector candidate) or with an addition corresponding to the specialization that was chosen (e.g. in the upscale Customs and tax service of the federal government: financial candidates , customs inspector candidates (new) or judicial officers).

Job title in the probationary period: Up until April 1, 2009, civil service law made a distinction between hiring (start of employment) and employment (end of probationary period, at the latest when appointed as a civil servant for life). After passing the career test or, in the case of special careers , directly after being hired, the civil servant used the official title in the form of the official title of the incoming office with the addition “for employment”, e.g. B. Government inspector for employment (abbreviation "z. A".). The award of office only took place after a successful trial period in terms of both career and status law, but no later than when the status of a civil servant was conferred for life. The Civil Service Status Act abolished the distinction between employment and recruitment. The job title in the probationary period now corresponds to the official title in the incoming office.

In Saxony-Anhalt, since February 1, 2010, civil servants and former civil servants who have previously held an office designation of the senior service of salary group A 13 can be awarded the office designation council with a corresponding addition on request (for example government councilor instead of senior government councilor, police councilor instead of first Police chief inspector). Officials appointed after the date will be given the title immediately. Since February 1, 2010, retired civil servants (higher government office council) may use the official title council with the appropriate addition and the addition “out of service” or “a. D. “lead. In Saxony-Anhalt, the former senior posts have ceased to exist due to the change in structure. The previous higher and higher service were combined in career group 2. This change is becoming apparent in many countries.
