The district court of Plön is a German court of ordinary jurisdiction . It is one of seven local courts in the district of the Kiel Regional Court and one of 22 local courts in the federal state of Schleswig-Holstein .

    history

    The district court of Plön was established in 1867. In 1975 and 1976 the neighboring district courts in Lütjenburg , Preetz , Rantzau and Schönberg (Holstein) were dissolved and their judicial districts were added to the district court of Plön. In the 1990s, the Plön District Court was a model court for the IT solution "MEGA" (multi-country court automation) as part of a cooperation between the states of Schleswig-Holstein, Brandenburg and Thuringia.

    The district court was initially housed in today's town hall from 1817 before moving into a new building at Lütjenburger Straße 48 in the early 1980s . The district court has had a waiting room for children since 2005.

    Superior courts

    The district court of Plön is one of seven district courts in the district of the district court of Kiel . The competent higher regional court is the Schleswig-Holstein Higher Regional Court in Schleswig .

    Known procedures

    In 1996, the district court of Plön submitted the question to the Federal Constitutional Court as part of a specific regulatory review as to whether the Electricity Feed Act was compatible with the Basic Law . However, the Federal Constitutional Court returned the files unprocessed after four years.

    On December 10, 2007, the district court ruled in a dispute between mobile phone users and providers that the threat of a Schufa entry for disputed invoice items was inadmissible, which is common in the industry . This is derived from Section 1004 (1) analogously, Section 823 (1) BGB in conjunction with Article 1 , Article 2 (1) GG . The Schufa report therefore represents a serious encroachment on the personal rights of the person concerned and massively damages their creditworthiness. In the event of a violation, the defendant provider was threatened with a fine of € 250,000. This decision is a relief for users with no legal knowledge, since threats with Schufa entries can no longer be used as a means of pressure.
