The recognition of foreign professional qualifications is, in the sense of professional law, the permission to use a professional qualification acquired in one state in another state. Regulations for the recognition of professional qualifications acquired abroad are intended to enable greater mobility in the education and labor market. Authorities or employers abroad can, for example, require a Certificate of professional qualification for the exercise of a profession .

Recognition can be regulated through intergovernmental agreements , for example through free trade agreements .

Professional associations point out that recognition should only take place if there is actually an equivalent level of training.

European Union

In the European Union, the recognition of professional qualifications is regulated by Directive 2013/55 / ​​EU, which amended Directive 2005/36 / EC on the recognition of professional qualifications (European Professional Recognition Directive). On the basis of 2013/55 / ​​EU, there is automatic recognition of professional qualifications for a limited number of professions, and recognition through the European Professional Card (EBA) is possible for a number of other professions . The EBA is an electronic procedure for the recognition of professional qualifications in another EU country. The EBA makes it possible to practice the profession temporarily and occasionally in another EU country or to practice it there permanently (professional establishment).

A Europe-wide harmonization of professional and university degrees was also sought through the Bologna Process . The European Qualifications Framework (EQF) aims to make professional qualifications and competences in Europe more comparable. The EQF is a non-binding recommendation for the Member States.

An example of the strengthening of international recognition of professional qualifications in the field of engineering is the title “ European Engineer ” (EUR ING) from the Federation of European National Engineering Associations (FEANI).

Germany

On the basis of Section 17a of the Residence Act , a foreigner can, under certain circumstances, receive a residence permit for up to 18 months for an educational measure and a subsequent examination for the purpose of recognizing a professional qualification acquired abroad.

There are professions that are not recognized by the federal government, but by the federal states. State law regulates in particular the teaching and educating professions.
