Candidate (civil service law)
In German civil service law, a candidate is a natural person with the status of a civil servant on revocation who is in preparatory service (career training). Special training and examination ( or ) regulations apply that the federal government and the states have issued for each individual career. The Vocational Training Act or collective agreements for apprentices / students in the public service do not apply to applicants. If the candidate is not yet of legal age , however, the Youth Labor Protection Act applies.
The candidate carries a service title of the desired office with a corresponding addition identifying the career path , e.g. B. tax secretary, city secretary, fire chief, police chief (mD) / police commissioner (gD), government inspector or the designation of the desired career with the addition of candidate, z. B. Financial candidates, trainee teacher, trainee building supervisor or service and official titles of the German customs administration (trainee customs secretary).
Training for the middle service usually lasts two years (deviating for technical careers that require prior training: 18 months), for the senior service three years. Theoretical training for the higher service is z. Currently, the majority of employers have graduated from a special college for the public service (e.g. federal college for public administration ). The successful completion of training usually includes a university of applied sciences diploma ( Diplom-Verwaltungswirt (FH) , Diplom-Verwaltungsbetriebswirt (FH) , Diplom-Finanzwirt (FH) , Diplom- Rechtspfleger (FH) , Diplom-Verwaltungsinformatiker etc.) or a corresponding bachelor's degree . The state of Baden-Württemberg continues to train applicants for the technical high-level service (building supervisors).
A candidate for a post in the category of higher service - except for the fully qualified lawyers - is usually considered clerk referred to a career identifying additional such. B. Government trainee (service title). The police are an exception . Here, depending on their desired career, they are called either trainee detective or police advisor .
The preparatory service usually ends with passing the written and oral final exams (similar to vocational training under the Vocational Training Act) or after minimum training or study times. In this respect, the civil servant relationship ends upon revocation by law, i. H. In the event of non-acceptance through renewed employment with reference to the civil service on probation, no release from the civil service on revocation is required.
Candidate Pay
Candidates do not receive any salaries, but receive so-called candidate salaries, the amount of which is detailed in Annex VIII to the Federal Salary Act (BBesG) and the corresponding regulations in the state salary laws. Candidate payments are part of the salary ( Section 1 (3) No. 1 BBesG). The amount of the basic amount depends on the entrance office , which the candidate enters immediately after completing the preparatory service. A candidate for a career in middle service receives a basic candidate amount of 1,268.99 euros from the federal government. [obsolete] There is also an entitlement to the family allowance and capital-building benefits . If there is a significant shortage of qualified applicants, the Federal Ministry of the Interior, for Building and Home Affairs or the position it has designated can grant candidate special supplements. They should not exceed 70 percent of the basic applicant amount and may not exceed 100 percent of the basic applicant amount. (cf. § 63 Abs. 1 BBesG)
If the training target is not achieved, the remuneration can be reduced for the period up to the repeat examination (cf. § 66 BBesG).
The basic applicant amount may be increased by the family allowance level 1 (married) or level 2 (one child). Up to the third child, a correspondingly higher family allowance is paid for each child; the amount of the allowance per child remains the same for each additional child.
In addition, some states / employers still grant special payments (formerly Christmas bonuses), which are paid monthly or annually depending on the state. The payment of the child allowance as well as a vacation allowance is also handled on a country-specific basis.
