Guarding permit

The Security permission referred to in Germany , the official permission commercial guarding foreign life or property. The legal basis for this can be found in Section 34a of the Trade Regulations and in the Guarding Ordinance . Depending on the activity, either the instruction according to § 34a Abs. 2 Nr. 1 GewO or the proficiency test according to § 34a Abs. 2 Nr. 2 GewO is required. The security permit is issued by the responsible trade authority, for example the public order office.

Briefing

The instruction according to § 34a GewO is only carried out by the Chamber of Industry and Commerce and basically represents the minimum requirement for an activity in the security industry. 40 teaching units of 45 minutes each are provided for security personnel.

Courses are held in German. Sufficient language skills are therefore a prerequisite for both registration and participation in the instruction process. The language skills must be at least at the level B1 of the Common European Framework of Reference (§ 6 Abs. 1 BewachV). Chambers reserve the right to check language skills and to refuse participants with insufficient language skills the proof of instruction.

Oral and written comprehension questions are used to test whether the participants are familiar with the necessary legal regulations and subject-specific obligations, as well as the powers and their practical application.

In addition, there is a 100 percent attendance requirement (Section 6 (2) BewachV).

Expertise examination

The competence examination according to § 34a GewO is carried out by the local Chamber of Industry and Commerce, it is divided into a written part of 120 minutes and an oral part (individual or group examination , 15 minutes per participant). The proficiency test is required for patrols in public traffic areas or in domiciliary rights areas with actual public traffic (e.g. pedestrian zones, public parks) or shopping centers (so-called city strips), for department store detectives (protection against shoplifters) or bouncers / admission control at hotel and restaurant discos or when working as a manager Function in the guarding of refugee accommodation / initial reception facilities and managerial function at large events with access protection. Likewise, the proficiency test is mandatory for owners (individual owners) of a security company or managing director of a GmbH who is responsible for the implementation of security tasks.

Generally exempt from the proficiency test are people who can provide evidence of a professional qualification relevant to the security industry, including specialists for protection and security / service personnel for protection and security or IHK-certified protection and security personnel (old factory security specialists ) or masters for protection and security ( old security officer ).

Furthermore, people are free, which successfully concluded in the context of a career examination at least for the middle Polizeivollzugsdienst , the central Prison Service , for the central customs service (with authorization to use a weapon) and for military police of the armed forces have purchased.

For persons who on January 1, 2003 had been authorized to work in the security industry for at least three years and without interruption, evidence of the expert examination in accordance with Section 23 (2) of the Security Ordinance is deemed to have been provided.

Furthermore, a successfully passed examination in the security industry leads to an exemption from the instruction according to § 34a GewO.
